«Ցեղասպանություն» ասելու համար Գարո Փայլանի դեմ հետաքննություն է սկսվել ՔՕ 301-րդ հոդվածով

Թուրքիայի քրդամետ Ժողովուրդների դեմոկրատական կուսակցության հայ պատգամավոր Գարո Փայլանի դեմ քրեական օրենսգրքի տխրահռչակ 301-րդ հոդվածով հետաքննություն է սկսվել: Հետաքննության շրջանակում կազմվել է նրան անձեռնմխելիությունից զրկելու պահանջագիր: Ինչպես հաղորդում է «Արմենպրես»-ը, այս մասին հայտնում է թուրքական Evrensel պարբերականը:
Անկարայի հանրապետական դատախազության կողմից կազմված պահանջագրում նշվում է, որ Փայլանը Կանադայի հայկականHorizon Weeklyպարբերականին տված հարցազրույցում հայտարարել է, որ «Թուրքիայում ցեղասպանություն է իրականացվել և այն դեռ շարունակվում է»: Այս հայտարարության հետ կապված հայ օրենսդիրի դեմ բողոք է ներկայացրել թուրք պրոֆեսոր Այգյուն Աթարը: Բողոքին ընթացք է տրվել և սկսվել է հետաքննություն:
Փայլանին անձեռնմխելիությունից զրկելու մասինպահանջագրում ասվում է, թե նա«հրապարակայնորեն նվաստացրել էԹուրքիայիՀանրապետությունն ու Թուրքիայիկառավարությունը, վիրավորել էհանրապետության նախագահին»:
Թուրքիայի սահմանադրության 83-րդ հոդվածը ենթադրում է, որ հանցանք գործած պատգամավորը չի կարող հարցաքննվել, ձերբակալվել կամ կալանավորվել առանց մեջլիսիհամապատասխան որոշման: Հետևաբար, դատախազությունը պետք է հատուկ դիմում ուղարկի Թուրքիայի արդարադատությաննախարարությանը, որպեսզի վերջինն էլ դիմի մեջլիսի նախագահությանը:
Թուրքիայի մեջլիսի նախագահություններկայացվելուց հետո հարցը քննարկման էդրվում հատուկ հանձնաժողովում, որիկազմումեն մեջլիսի սահմանադրական ևարդարադատության հարցերովհանձնաժողովների անդամները: Հանձնաժողովըհարցնուսումնասիրելուց հետո պատրաստում էհամապատասխան զեկույց, որը վերջնականքվեարկության է դրվում մեջլիսինիստիժամանակ:
Պատգամավորներն իրավունք ունեն ինչպեսհանձնաժողովում, այնպես էլ մեջլիսի նիստիժամանակ հանդես գալ պաշտպանականխոսքով: Անձեռնմխելիությունից զրկվելու պարագայումնրանք կարող են հարցը բողոքարկելՍահմանադրական դատարանում:
Թուրքիայի քրեական օրենսգրքի 301-րդ հոդվածըենթադրում է քրեական պատասխանատվությանենթարկել այն անձանց, ովքեր վիրավորում ենթուրք ժողովրդին, պետության, թուրքականությանը, երկրիպետականկառույցներին, զինծառայողներին ևիրավապահներին:
Թուրքիայի ՔՕ 301-րդ հոդվածով էր դատապարտվել նաև «Ակօս» շաբաթաթերթինախկին խմբագրապետ Հրանտ Դինքը։
