Նիկոլայ Բաղդասարյան.«Եթե մայիսի 8-ին կրկին վարչապետ չընտրվի, ապա երկիրը կմտնի ավելի խորը ճգնաժամի մեջ»
POLITICSԱրդեն հայտնի է, որ մայիսի 8-ին ԱԺ-ում տեղի կունենա վարչապետի թեկնածուի ընտրության երկրորդ փորձը: Ու չնայած դժվար է ասել, թե ՀՀԿ-ն այս անգամ ինչպես իրեն կդրսևորի, սակայն հետաքրքիր է, թե օրենքով երկրորդ անգամ ինչպես է իրականացվելու ընտրությունը:
Փաստաբան Նիկոլայ Բաղդասարյանը Past.am-ին փոխանցեց, որ ըստ գործող Սահմանադրության, վարչապետի թեկնածուի երկրորդ անգամ առաջադրումը, պետք է իրականացվի ոչ թե ԱԺ խմբակցությունների, այլ պատգամավորների 1/3-ի կողմից:
«Այս դեպքում նույնպես, առաջադրված թեկնածուն որպեսզի համարվի ընտրված, պետք է նրա օգտին քվեարկի 53 պատգամավոր: Ինձ հասած տեղեկությունների համաձայն, սակայն, ևս երկու պատգամավոր ՀՀԿ խմբակցությունից դուրս գալու դիմում է ներկայացրել: Այսինքն, ՀՀԿ-ն սեփական թեկնածուին առաջադրելու դեպքում անգամ չի կարողանա ապահովել անցողիկ ձայների քանակը»,- ասաց Ն. Բաղդասարյանը:
Ըստ նրա, այս պահին պարալիզացված է նաև ողջ դատական համակարգի աշխատանքը:
«Դատական նիստեր տեղի չեն ունենում, և այս ամենը վկայում է, որ ըստ էության պարալիզացվել է պետության արդարադատություն իրականացնող համակարգը: Հետևաբար այս իրավիճակը չի կարող 1-2 օրից ավել շարունակվել»,- ասաց Ն. Բաղդասարյանը:
Հարցին, թե մինչև մայիսի 8-ը ՀՀԿ-ն ուրիշ ինչ այլ սցենարներով կարող է շարժվել, փաստաբանն ասաց, որ ՀՀԿ-ն միայն մի ելք ունի:
«Ըստ էության ՀՀԿ-ն այս պահին ընդամենը մի քանի օլիգարխներ են, որոնք ցանկանում են պահպանել իրենց դիրքերը: Պետք է նշել նաև, որ ՀՀԿ-ի կողմից թեկնածու չառաջադրելու պարագայում ՀՀԿ-ի թեկնածուն շարունակում է պաշտոնավարել այնքան ժամանակ, մինչև նոր առաջադրված թեկնածուն չհաղթի: Այսինքն, տապալելով վարչապետի ընտրության գործընթացը, ՀՀԿ-ն փաստացի պահպանում է իր թեկնածուի պաշտոնավարման ժամկետը»,- ասաց Ն.Բաղդասարյանը:
Փաստաբանի տեղեկացմամբ մայիսի 8-ին, եթե կրկնվի նույն սցենարը, և փաստացի կրկին տապալվի վարչապետի ընտրությունը, ապա ողջ երկիրը կմտնի ավելի խորը ճգնաժամի մեջ, որի ժամանակ անգամ խորհրդարանական ընտրություն կազմակերպել հնարավոր չի լինի:
«Այդ դեպքում արդեն ընտրություն չի կայանա, քանի որ պարալիզացված կլինեն բոլոր պետական համակարգերը»,- խոսքը եզրափակեց փաստաբանը:
