Պետք է կանխել բախումները

Ցավոք, բանակցությունները չստացվեցին:
Այս իրավիճակի հետ կապված կցանկանայի ներկայացնել իմ անձնական տեսակետը:
Նախ, պետք է նշել, որ՝
- բոլորը մեր հայրենակիցներն են.
- քաղաքացիների, այդ թվում՝ երիտասարդների միասնական ոգին չի կարելի կոտրել: Այս նույն ոգին է, որ պատերազմի ժամանակ մեզ առավելություն է տալիս և հաղթանակի մեծ հնարավորություն.
- այս կոնֆլիկտի արդյունքում պետք է հաղթողը լինի մեր երկիրը.
- հարկադրանք/ուժ կիրառելու մենաշնորհը պատկանում է պետությանը, որը կիրառելիս պետությունը կաշկանդված է մի շարք սահմանադրական և միջազգային սկզբունքներով (համաչափության, անհրաժեշտության և այլն).
- հավաքների ժամանակ, առաջ կամ հետո արձանագրվել են բռնության դեպքեր, ինչպես քաղաքացիների (այդ թվում՝ սադրիչների), այնպես էլ ոստիկանների կողմից:
Հավաքների ազատության իրավունքը Սահմանադրությամբ երաշխավորված հիմնարար իրավունք է։ «Հավաքների ազատության մասին» ՀՀ օրենքը սահմանում է պետության պոզիտիվ պարտականությունը ապահովելու համար հավաքների ազատության իրականացումը:
«Հավաքների ազատության մասին» ՀՀ օրենքը 32-րդ հոդվածի 2-րդ մասի համաձայն՝ եթե հավաքն անցկացվում է սույն օրենքի 2-րդ գլխով նախատեսված իրազեկմանը վերաբերող պահանջների խախտմամբ, ապա ոստիկանությունը պարտավոր է բարձրախոսով տեղեկացնել, որ հավաքն անօրինական է, և որ մասնակիցները ենթակա են օրենքով սահմանված պատասխանատվության։ Եթե հավաքը խաղաղ բնույթ ունի, ապա ոստիկանությունն իր իրավասությունների սահմաններում պարտավոր է աջակցել հավաքին։
Հետևաբար, նշված հոդվածի ամենակարևոր պայմանը, դա հավաքի խաղաղ լինելն է: Եթե հավաքի կազմակերպիչները վերահսկում են իրավիճակը և թույլ չեն տալիս բռնության դեպքեր, որոնք մեծաթիվ բազմության, ինչպես նաև վերջնագրային պահանջների դեպքում շատ դժվար է ապահովել, ապա ոստիկանությունը չպետք է հարկադրանքի միջոց կիրառի:
Պետք է նկատի ունենալ նաև «Հավաքների ազատության մասին» ՀՀ օրենքի 33-րդ հոդվածի 1-ին մասի պահանջը, ըստ որի՝ ոստիկանությունը կարող է դադարեցնել հավաքը միայն այն դեպքում, եթե այլ կերպ հնարավոր չէ կանխել այլ անձանց հիմնական իրավունքների կամ հանրության շահերի անհամաչափ սահմանափակումը։ Ուստի հավաքների կազմակերպման ժամանակ պետք է խուսափել անձանց հիմնական իրավունքները և հանրության շահերն անհամաչափ սահմանափակող գործողություններից:
Ստեղծված իրավիճակում խնդիրը կարող է լավագույն ձևով լուծվել երկխոսության ճանապարհով: Որոշ արկածախնդիր հայրենակիցներ միգուցե չեն համաձայնվի ինձ հետ և այս փակուղային իրավիճակում լուծումը կտեսնեն «առաջ» գնալու մեջ, բայց այդ ճանապարհը տանելու է բախումների, դրանից բխող անդառնալի հետևանքներով:
Կարելի է երկխոսության ճանապարհով հասնել նաև նրան, որ՝
- համընդհանուր բարեփոխումների ծրագիր հաստատվի և իրականացվի,
- այս օրերին ապօրինություն թույլ տված անձինք, այդ թվում՝ սադրանքներ հրահրած անձինք, պատասխանատվության ենթարկվեն:
