Սահմանադրության բարեփոխման նախագիծ. Մանրամասներ

Սահմանադրությունը երկրի այն հիմնական օրենքն է, որը չի կարող կարևոր և ոչ այնքան կարևոր, առավել ևս` անկարևոր հոդվածներ ունենալ: Բայց որոշ մանրամասներ, ամեն դեպքում, արժե քննարկել: Օրինակ` երկրի նախագահի և վարչապետի իշխանության տարանջատումը: Համամասնական ընտրակարգ ունեցող երկրներում երբեմն թյուրիմացություն կամ նույնիսկ հակասություն է առաջանում, թե տվյալ կոնկրետ դեպքում ում իրավասությանն է պատկանում այս կամ այն հարցի կարգավորումը:
Պարզ է, որ Սահմանադրության տեքստում ամեն բան հնարավոր չէ նախատեսել, շատ հարցեր կարող են և կարգավորվում են օրենքներով: Բայց Սահմանադրությունն է յուրաքանչյուր օրենքի հիմքը, ուստի դիմենք որոշ մանրամասների համեմատությանը: Ըստ Սահմանադրության բարեփոխման նախագծի, երկրի նախագահն ընտրվում է Ազգային ժողովի կողմից: «Հանրապետության նախագահ է ընտրվում այն թեկնածուն, որը ստացել է պատգամավորների ընդհանուր թվի ձայների առնվազն երեք քառորդը»,- հռչակում է նախագծի 125- րդ հոդվածի 4- րդ կետը: Եթե ընտրության երկրորդ և երրորդ փուլերն էլ են անարդյունք ավարտվում, «ապա տասնօրյա ժամկետում անցկացվում է Հանրապետության նախագահի նոր ընտրություն»:
Այժմ գանք վարչապետին: Ինչպես և այժմ, այդ նշանակումը կատարում է երկրի նախագահը, բայց մի էական տարբերությամբ. նա չունի սեփական գերապատվության իրավունք և «անհապաղ վարչապետ է նշանակում խորհրդարանական մեծամասնության ներկայացրած թեկնածուին»: Գրեթե նույն սկզբունքով է կազմավորվում ամբողջ կառավարությունը. «Իր նշանակումից հետո վարչապետը հնգօրյա ժամկետում Հանրապետության նախագահին առաջարկում է փոխվարչապետների և նախարարների թեկնածուներին: Հանրապետության նախագահը եռօրյա ժամկետում կամ նշանակում է փոխվարչապետներին և նախարարներին, կամ դիմում Սահմանադրական դատարան:
Սահմանադրական դատարանը դիմումը քննում և որոշում է կայացնում հնգօրյա ժամկետում: Եթե Հանրապետության նախագահը եռօրյա ժամկետում չի կատարում սույն հոդվածով /150- րդ/ սահմանված պահանջները, ապա համապատասխան փոխվարչապետը կամ նախարարը նշանակված է համարվում իրավուքի ուժով»: Այսպիսով, կադրային նշանակման հարցում հայտնվում է ևս մեկ դերակատար` Սահմանադրական դատարանը:
Ինչպես տեսնում ենք, կառավարության անդամ նշանակելու ժամանակ Սահմանադրությունը պարտադրում է հաշվի առնել ոչ միայն բազմակուսակ- ցական Ազգային ժողովի քվեարկության արդյունքը, այլև վարչապետի, նախագահի և վերջապես Սահմանադրական դատարանի կարծիքն ու եզրակացությունը: Նույնիսկ հպանցիկ հայացքը վկայում է, որ Հիմնական օրենքի բարեփոխման նախագիծն առաջարկում է երկրի վարչապետի և նախագահի իշխանության տարանջատման ողջամիտ հակակշիռներ, որոնք գրեթե բացառում են որևէ թյուրիմացություն կամ հակասություն:
