Մաքսատան ավագ տեսուչը մեղադրվում է կեղծ փաստաթղթեր կազմելու մեջ

Երևանի բնակիչ Սուրիկ Շահբազյանին ՀՀ քրեական օրենսգրքի 314-րդ հոդվածի առաջին մասի հատկանիշներով մեղադրանք է առաջադրվել: Այս մասին հայտնի դարձավ դատական տեղեկատվական համակարգից: ՀՀ ֆինանսների նախարարության ավտոտրանսպորտային միջոցների մաքսային ձևակերպո ւմների մասնագիտացված մաքսատան ձևակերպումների բաժնի ավագ մաքսային տեսուչ Սուրիկ Մարտունիկի Շահբազյանը 2014թվականի մայիսին Երևանի «Կիլիկիա» թաղամասում հայտնաբերել և նույն մաքսատուն է ներկայացրել մաքսային հսկողության ներքո գտնվող` Շահեն Խաչատրյանի կողմից Արտեմ Վարդանյանին հանձնված և վերջինիս կողմից շահագործվող «Մերսեդես-բենց Տ320Լ» մակնիշի 1356 JL հաշվառման համարանիշի ավտոմեքենան:
Դրանից հետո Սուրիկ Շահբազյանը խախտել է ՀՀ մաքսային օրենսգրքի 207-րդ հոդվածի 1-ին մասի «ա» կետի պահանջները, քանի որ իր լիազորություններն իրականացնելիս մաքսային հսկողության ներքո գտնվող տրանսպորտային միջոցն առանց մաքսային մարմնի թույլտվության այլ անձի հանձնելու հանգամանքը հայտնաբերելուց հետո, մաքսային կանոնների խախտման վերաբերյալ գործի վարույթ չի սկսել:
Մեղադրյալն օրենքի դրույթը շուրջ 2 ամիս չկատարելու հանգամանքը թաքցնելու անձնական դրդումներից ելնելով` 2014թվականի հուլիսի 7-ին կազմել և մաքսատան գրասենյակ հանձնելու եղանակով շրջանառության մեջ է դրել իրավաբանական նշանակություն ունեցող փաստեր և իրադարձություններ հաստատող կեղծ փաստաթուղթ հանդիսացող զեկուցագիր:
Այդ զեկուցագրում Սուրիկ Շահբազյանը նշել է, թե իբր մաքսային հսկողության ներքո գտնվող` Շահեն Խաչատրյանի կողմից Արտեմ Վարդանյանին հանձնված և վերջինիս կողմից շահագործվող ավտոմեքենան հայտնաբերել և մաքսատուն է ներկայացրել 2014թ. հուլիսի 6-ին:
Վերը նշված քրեական հոդվածով մեղադրյալին սպառնում է նվազագույն աշխատավարձի երկուհարյուրապատիկից չորսհարյուրապատիկի չափով տուգանք, մեկից երկու տարի ժամկետով ուղղիչ աշխատանքներ, մեկից երեք ամիս ժամկետով կալանք, կամ առավելագույնը երկու տարի ժամկետով ազատազրկում:
