Կառավարության կողմից «ջրված» պարտքը չի մարսվել

ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունն, ուսումնասիրելով հողօգտագործողներին գյուղատնտեսական աշխատանքների համար մատչելի գներով պարարտանյութերի ձեռքբերման նպատակով պետական աջակցության ծրագրի իրականացման գործընթացը, պարզել է, որ Լոռու մարզպետարանի կողմից նախկին Միխայլովկա համայնքի ղեկավարին հանձնվել է պարարտանյութ, որի դիմաց վերջինը 8 մլն 274 հազար դրամը չի վճարել պետբյուջե:

Նշենք, որ Միխայլովկա համայնքն այժմ Մեծավան խոշորացված համայնքի կազմում է, սակայն, պարզվում է, որ խոշորացումը չի օգնել նախկին համայնքապետերին ստանձնած պարտավորություններից խուսափել: Նշենք նաև, որ Լոռու մարզպետարանը նշված գումարի բռնագանձման պահանջով դիմել է դատարան, հայցը բավարարվել է և ուժի մեջ մտել 

2016թ. հունիսի 27-ին, սակայն մարզպետարանի պատասխանատու պաշտոնատար անձանց կողմից միջոցներ չեն ձեռնարկվել օրենքով սահմանված ժամկետներում դիմելու ԴԱՀԿ-ին: Փաստացի, դատական ակտի կատարման ժամկետը բաց է թողնվել:

Զավեշտալին սակայն այն է, որ հետագայում մարզպետարանը պարտքը ջրելու համար դիմել է նաև ՀՀ կառավարությանը, և կառավարության 07.12.2017-ի որոշմամբ այն ամբողջությամբ զիջվել է՝ որպես համայնքի պարտավորություն:

Գործի ուսումնասիրությամբ ՀՀ դատախազության պետական շահերի պաշտպանության վարչությունը պարզել է, որ փաստորեն մարզպետարանի պաշտոնատար անձանց վարքագծի և իրենց աշխատանքի հանդեպ ցուցաբերած անբարեխիղճ վերաբերմունքի պատճառով պետությանը պատճառվել է բավականին խոշոր չափերի վնաս:

Պետական մարմի ուսումնասիրությունները հանգեցրել են այն եզրակացության, որ արձանագրված խախտումները պարունակում են հանցագործության հատկանիշներ, և ՀՀ քրեական օրենսգրքի 315-րդ հոդվածի 1-ին մասով նախատեսված հատկանիշներով հարուցվել է քրեական գործ, որի նախաքննության կատարումը հանձնարարվել է ՀՀ քննչական կոմիտեին:

Ստացվում է, եկել է ժամանակը, որ նույնիսկ կառավարության որոշմամբ «ջրված» պարտքերը մարսելն էլ հեշտ չի լինի: Ինչ վերաբերում է մարզպետարանի աշխատակիցներին, ապա առանց վերադասների «դաբրոյի» նրանք դժվար թե կարողանային ինքնագլուխ կերպով այդքան մեծ գումարներ լվանալ: Մնում է տեսնել, թե նախաքննական մարմնի «դուխը» մինչև որ օղակ բարձրանալուն կհերիքի, և կրկին պատասխանատվության կենթարկվեն մարզի «պահակի», թե առաջին դեմքի մակարդակով:
