Օրենքով՝ դեղերի ցանկը պետք է հաստատված լիներ նախարարի հրամանով
SOCIETY«Իրավաբանների հայկական ասոցիացիան» և «Հայաստանի բժիշկների ասոցիացիան» համատեղ հայտարարություն են տարածել, որով տեղեկացնում են, որ կառավարության որոշմամբ ընդունվել է դեղատոմսերի ձևը, դեղատոմսեր գրելու, դեղեր բաց թողնելու և հաշվառելու կարգը, սակայն այդ որոշման մեջ չկա, այն դեղերի ցանկը, որոնք ենթակա են դեղատոմսով կամ առանց դեղատոմսի բաց թողնման:
Հայտարարության մեջ ասվում է նաև, որ «Դեղերի մասին» օրենքի 16-րդ հոդվածի25-րդ կետի համաձայն էլ սահմանվում է, որ դեղատոմսով և առանց դեղատոմսի դուրս գրվող դեղերի ցանկը պետք է հաստատվի ՀՀ առողջապահության նախարարի կողմից: Բացի այդ, պետք է ապահովվի նաև ցանկի թափանցիկությունը, որպեսզի բոլոր սպառողները կարողանան անարգել ծանոթանալ այդ ցանկերին:
Նշված ասոցիացիաները, սակայն, մտահոգություն են հայտնում, որ առողջապահության նախարարության կողմից թեև այդ ցանկերը հրապարակվել են, սակայն պարզ չէ, թե այն ինչ իրավական ակտով է հաստատվել:
Այսինքն, այս պահին չկա որևէ իրավական ակտ, որի հիման վրա հնարավոր լինի դասակարգել, թե որ դեղը ինչ սկզբունքով պետք է բաց թողնվի: Օրենքների համադրումից պարզ է դառնում, որ այս պահին սկսված՝ դեղերը դեղատոմսերով բաց թողնելու գործընթացը հիմնավորված չէ: Ավելին, օրենքով չհիմնավորված գործողություն կատարելու համար անձինք կարող են ենթարկվել պատասխանատվության օրենքի պահանջը չկատարելու համար:
Սրանից բացի, ըստ ասոցիացիաների հայտարարության «Դեղերի մասին» օրենքն ունի բավականաչափ այլ բացեր ևս, որոնք կարող են խոչընդոտել օրենքի արդյունավետ կիրառումը և կարող են կոռուպցիոն ռիսկերի պատճառ դառնալ:
«Իրավաբանների հայկական ասոցիացիան» և «Հայաստանի բժիշկների ասոցիացիան» պատրաստակամություն են հայտնել աջակցելու, որպեսզի իրենց կողմից վերհանած խնդիրները լուծելու նպատակով ստեղծվի աշխատանքային խումբ, որը հնարավորություն կտա ավելի կատարյալ դարձնել ոչ միայն «Դեղերի մասին» օրենքը, այլև փակվեն այն սողանցքները, որոնք հարցին առնչվող այլ օրենքների ու իրավական փաստաթղթերի համադրման արդյունքում կան:
