Օրեր առաջ Past.am-ը գրել էր, որ չնայած փետրվարի 9-ին ՀՀ Ազգային ժողովը 59 կողմ, 25 դեմ, 10 ձեռնպահ ձայներով ընդունել է ՀՀ քաղաքացիական դատավարության օրենսգիրքը, որում այդպես էլ ներառված մնաց փաստաբաններին տուգանելու դրույթը, սակայն փաստաբանների պալատի անդամները շարունակում են պայքարել օրենքում տեղ գտած դրույթը չեղյալ հայտարարելու համար:

Նրանք շարունակում են պնդել, որ դատավորի կողմից փաստաբանին տուգանելու իրավասությունը ոչ միայն չի օգնի անկախ դատական համակարգի ձևավորմանը, այլև կխոչընդոտի փաստաբանի կողմից լիարժեք մասնագիտական ծառայություն մատուցելուն, իսկ մարդիկ կլինեն ավելի անպաշտպան, քան հիմա են: Նախաձեռնող խումբը դիմել էր ՀՀ նախագահին՝ ՀՀ Ազգային ժողովի կողմից ընդունված ՀՀ քաղաքացիական դատավարության օրենսգիրքը և փաթեթի մեջ ներառված օրենքները համապատասխան առարկություններով և առաջարկություններով ՀՀ Ազգային ժողով վերադարձնելու և քննարկում պահանջելու խնդրանքով:
Ու թեև այդ դիմումից արդեն բավականին ժամանակ է անցել, սակայն փաստաբանները դեռևս չեն ստացել իրենց դիմումի պատասխանը:

Հիշեցնենք, որ փաստաբանները գտնում են, որ ՀՀ քաղաքացիական դատավարության օրենսգրքի նախագծում առաջին ընթերցումից հետո ավելացված` փաստաբաններին տուգանելու վերաբերյալ իրավակարգավորումը չունի հիմնավորում, և առկա չէ այդ իրավակարգավորման ընդունման անհրաժեշտությունը: Բայց ինչպես երևում է, դա այս օրերին այնքան էլ հրատապ հարցերից չէ: Հակառակ դեպքում փաստաբանների դիմումը որևէ արձագանքի կարժանանար:
