Նախորդ շաբաթ Երևանի Շենգավիթ վարչական շրջանի ընդհանուր իրավասության դատարանում Ժիրայր Սեֆիլյանի և մյուսների գործով դատական նիստին մեղադրող Հակոբ Ենոքյանը հրապարակել էր մեղադրական եզրակացությունը, որով Ժիրայր Սեֆիլյանին կարող է սպառնալ մինչև 11 տարվա ազատազրկում:

Հիշեցնենք, որ նա մեղադրվում է  զանգվածային անկարգություններ կազմակերպելու նպատակով մարմնական վնասվածքներ հասցնելու համար գործիքներ ձեռք բերելու համար:

Ըստ մեղադրական կողմի՝ նրանք ծրագրել էին 2015թ. ապրիլի 24-ին զանգվածային անկարգություններ կազմակերպել հանրային վայրերում, որը, սակայն, ձախողվել է, քանի որ նրանք ավելի վաղ ձերբակալվել էին:  

Ժիրայր Սեֆիլյանի և մյուսների դատական գործի ավարտին հաշված նիստեր են մնացել: Ինչպես Past.am-ը տեղեկացավ Ժիրայր Սեֆիլյանի պաշտպան Տիգրան Հայրապետյանից՝ գործի ավարտին մնացել է մեկ կամ երկու նիստ:

Մեր հարցին, թե ինչ ակնկալիքներ ունեն դատական գործի ավարտից և արդյոք կարելի է ակնկալել, որ դատարանը մեղադրողի կողմից հնչեցված 11 տարի ազատազրկումը կարող է մեղմել, փաստաբանը պատասխանեց, թե դա դատարանից  կախված չէ:
«Դա ակնհայտ անօրինական դատավճիռ է: Դատարանը պետք է որոշի, եթե ակնհայտ անօրինական դատավճիռ կայացնի, հետագա բոլոր բացասական հետևանքները իր վրա են ընկնելու: Ակնհայտ անօրինական դատական ակտ կայացնելու համար անձինք պատժվում են քրեական պատասխանատվությամբ կամ, եթե դա էլ չի լինում, ինչ-որ ժամանակ անց, երբ դա բեկանվի կամ Եվրոպական դատարանում համարվի ակնհայտ անօրինական, մենք հետամուտ ենք լինելու, որ այդ դատավորը առնվազն չպաշտոնավարի:

Այս ամենը դատավորից է կախված: Նա պետք է որոշի՝ պատվեր կատարի, թե՝ ոչ: Իսկ դա պատվեր է: Ինքն իհարկե ավելի լավ գիտի, որ պատվերով դատական ակտ կայացնելը քրեորեն պատժելի արարք է: Թող որոշի, եթե այդ ճանապարհով է գնում, թող գնա»,- նշեց նա:

Հայրապետյանի խոսքով՝ այսօր Ժիրայր Սեֆիլյանը անօրինական, անտեղի կալանավորված է: Այսօր նա քաղաքական բանտարկյալի կլասիկ օրինակ է: Սակայն քաղաքական բանտարկյալ ունենալը ոչ մի պետության վայել չէ: Վաղ թե ուշ այդ պետությունը կամ պետք է քաղաքական բանտարկյալներին ազատ արձակի, կամ այլ պետություն դառնա, որտեղ քաղաքական բանտարկյալներ չեն լինելու: Սա էլ նշանակում է, որ պաշտոնավարողներն են փոխվելու:

«Այսինքն՝ վաղ թե ուշ Ժիրայր Սեֆիլյանը արդարացվելու է, քանի որ նա այսօր քաղաքական բանտարկյալ է: Քաղաքական բանտարկյալ է դատավորների պատճառով, ովքեր գործիք են պետության ձեռքին: Հետևաբար հետագա բոլոր դրական ու բացասական հետևանքներով թող որոշեն՝ պե՞տք է պատվեր կատարել, թե՝ ոչ»,- նկատեց մեր զրուցակիցը:
