Արդեն քանի օր է լրատվամիջոցների թոփ թեման է ՀՀ դատական նոր օրենսգրքում փաստաբանների նկատմամբ դատական տուգանք նշանակելու վերաբերյալ դրույթը, ըստ որի նիստը վարող դատավորին իրավունք կվերապահվի փաստաբանի նկատմամբ որպես սանկցիա կիրառել մինչեւ 100 հազար ՀՀ դրամի չափով տուգանք: Տվյալ իրավակարգավորման վերաբերյալ բացասական տեսակետ է հայտնել ոչ միայն ՀՀ Փաստաբանների պալատի Նախագահ Արա Զոհրաբյանը, այլեւ 1000-ից ավել փաստաբաններ, ովքեր սեփական իրավունքները պաշտպանելու հետաքրքիր մարտավարություն են մշակել՝ մեկօրյա գործադուլեր: Նշենք, որ փաստաբանների պահանջը ՀՀ Ազգային ժողովից և կառավարությունից մեկն է, նախագծում ներառված՝ փաստաբանի նկատմամբ դատարանի կողմից տուգանքի տեսքով դատական սանկցիա կիրառելու հնարավորությունը բացառել: Թեմայի շուրջ Past.am-ը զրուցել է Շիրակի մարզում անցկացված գործադուլի համակարգող Հայկ Հարությունյանի հետ.

«Մենք մտահոգություն ենք հայտնում ՀՀ դատական օրենսգրքում տեղ գտած փոփոխությունների վերաբերյալ: Օրենսգրքում կա դրույթ ըստ որի դատավորները հնարավորություն կունենան դատական սանկցիա կիրառել պաշտպանի նկատմամբ 100 հազար դրամի չափով: Այս դրույթում խնդրահարույցն այն է, որ չի նշվում, թե որ դեպքում կարող է կրառել ու որ դեպքում՝ ոչ: Այսինքն հստակ չեն մեխանիզմները: Ժամանակին գրված էր, որ սանկցիա կարող է կիրառվել, երբ պաշտպանը չի ենթարկվում դատարանի օրինական կարգադրություններին, իսկ հիմա հանել են օրինական բառը: Նշեմ, որ եթե փաստաբանը խախտում է վարքագծի կանոնները` դիմում են Փաստաբանների պալատ, հետո կարգապահական գործ է հարուցվում, հրավիրվում է տվյալ փաստաբանը, ինքն էլ իր տեսակետն է ներկայացնում ու նոր որոշում էր կայացվում: Վերը նշվածս դրույթով փաստացի շրջանցում են Փաստաբանների պալատը ու միանձնյա որոշում է կայացվելու: Տեղին է նշել նաեւ, որ ՓՊ-ն եւս իրավունք ունի փաստաբանին տուգանել, բանը կարող է հասնել անգամ արտոնագրից զրկելուն» ,- ասաց Հ. Հարությունյանն ընդգծելով, որ իրենք դեմ են դատավորի կողմից կայացվելիք միանձնյա որոշումներին:

Փաստաբանը սույն դրույթում փաստաբաններին ճնշելու ու նրանց աշխատանքը կաշկանդելու միտում է տեսնում. «Եթե մեկ կամ երկու անգամ փաստաբանին տուգանեն, ապա երրորդ անգամ նա կարող է կաշկանդվել իր գործում: Նրանք ցանկանում են, որ փաստաբանները դառնան կամակատար ու չկարողանան ամբողջությամբ ներկայացնել իրենց վստահորդի շահերը: Սա միանշանակ ուղղված է փաստաբանների անկախության դեմ»,-ընդգծեց փաստաբանը՝ հավելելով` «Ամսի 24-ին մենք մեկօրյա նախազգուշական գործադուլ ենք արել, սակայն սա ընդամենը նախազգուշացում էր, մենք միանշանակ արդյունքի ենք հասնելու, սա ժամանակի հարց է: Տվալ դրույթը չի համապատասխանում այն կոնվենցիաներին, որոնց միացել ենք: Հակասահմանադրական է փաստաբանին նման ձեւով զսպելը: Եթե ակցիաներն անարձագանք մնան մենք նոր ու ավելի մեծ թափով ենք պայքարելու»,-ասաց Հ.Հարությունյանը:
