Փաստաբանները գործադուլ են անում՝ Դատական օրենսգրքի փոփոխությունը չեղարկելու պահանջով
SOCIETYԱյսօր Տավուշի և Արարատի մարզի թվով 70 փաստաբաններ գործադուլ կանեն՝ նրանք չեն մասնակցի դատական նիստերին՝ տապալելով դրանք: Նմանատիպ քայլի պատճառը Դատական օրենսգրքի նախագծի փոփոխությունն է, որը վերաբերում է փաստաբաններին տուգանելու իրավակարգավորմանը:
Բանն այն է, որ մինչ այժմ պաշտպանի կամ փաստաբանի՝ դատարանի կողմից սահմանված կարգը խախտելու կամ անհարգալից վերաբերմունք դրսևորելու դեպքում դատարանները սանկցիաներ կիրառելու համար համապատասխան կարգով դիմում էին Փաստաբանների պալատ: Պալատը ստանալով այդ պաշտպանի վերաբերյալ հաղորդումը, իրավասու էր քննարկել, հարուցել կարգապահական վարույթ, պարզելու՝ իրոք հիմքեր կա՞ն փաստաբանին պատասխանատվության ենթարկելու: Սա էլ իր հերթին ենթադրում էր նախազգուշացում, տուգանք՝ ընդհուպ մինչև համապատասխան փաստաբանական արտոնագրից զրկումը:
Այսօր արդեն սանկցիաների կիրառման կարգը փոխվել է: Այժմ դատարանները անմիջապես տուգանք կիրառելու իրավասություն ունեն, ինչը կարող է սուբյեկտիվ տուգանման պատճառ դառնալ:
Գործադուլին միացած Արարատի մարզի 54 և Տավուշի մարզի 16 փաստաբաններ պահանջում են ՀՀ դատական օրենսգրքի նախագծից հանել փաստաբաններին տուգանելու իրավակարգավորումը:
Տավուշի մարզի փաստաբանների ներկայացուցիչ, փաստաբան Արմեն Ադամյանը Past.am-ի հետ զրույցում տեղեկացրեց, որ իրենք այսօր, որպես նախազգուշական քայլ, մեկօրյա բողոքի ակցիա են իրականացնելու՝ հրաժարվելով Տավուշի և Արարատի մարզերում պետական մարմիններում՝ դատարաններում և նախաքննության մարմիններում պաշտպանություն կամ ներկայացուցչություն իրականացնել:
Առայժմ նախատեսվում է գործադուլ իրականացնել մեկ օր, սակայն հետագայում նաև այլ տարածքների փաստաբանների հետ միասին պայքարի ձևն ու միջոցները կորոշեն: Ըստ Ադամյանի՝ օրենսգրքի փոփոխությունը հակասում է շատ նորմերի և կարող է մրցակցության, հետագայում ենթադրյալ կաշկանդվածության ու կամայականությունների ավելացման պատճառ դառնալ:
«Յուրաքանչյուր փաստաբան իրավունք ունի դատաքննության ընթացքում անել միջնորդություններ, առարկություններ և հայտարարություններ, ընդ որում՝ ոչ միայն մասնակիցների, մեղադրողի, այլև՝ նույն դատարանի գործողության դեմ: Այսօր եթե մի դատավորի բացարկ ներկայացնենք, մի քանի անգամ առարկենք իր գործողությունների դեմ, նշված դատարանի մոտեցումը պաշտպանի նկատմամբ այլ է լինելու:
Եվ եթե այդ լծակը ընդունվի, ցանկացած պահի դատավորը կարող է տուգանել 100 հազար դրամով: Մեխանիկորեն ցանկացած պաշտպան, հաշվի առնելով տուգանքի սահմանված չափը և իր աշխատավարձը, բնական է, որ գնալու է ձևի համար խելոք նստի, որ ամեն ինչ դատավորի սրտով լինի: Բայց, հո 1937 թիվը չէ»-տարակուսեց փաստաբանը:
