ՏՄՊՊՀ-ն «Կարաս» բառի իրավատիրոջ փնտրտուքների մեջ
ECONOMICSՄտավոր սեփականության կողմից «Կարաս» անվանման գրանցման հետ կապված Տնտեսական մրցակցության պաշտպանության պետական Հանձնաժողովին է դիմել գինեգործությամբ զբաղվող «Սակի ընդ Սանս» ընկերությունը, որը հայտնի է «Զորահ կարասի» ապրանքանիշը ներկայացնող գինիներով:
Դիմում-բողոքում ընկերությունը տեղեկացրել է, որ գինու արտադրությունը հիմնել է դեռեւս 2001 թվականին՝ Վայոց ձորի մարզի Ռինդ գյուղում: Արտադրված գինիները անվանակոչվել է հիմնադիրի անձնանունով և մատնանշվել, որ դրանք հնեցված են կարասի մեջ, այդ իսկ պատճառով էլ անվանվել է «Զորահ կարասի»:
Հանձնաժողովի նախագահ Արտակ Շաբոյանը NEWS.am-ի հետ զրույցում տեղեկացրել է, որ ընկերությունը խնդիր ունի նույն ոլորտում գործող մեկ այլ՝ «Տիեռաս դե Արմենիա» ընկերության հետ, որը ներկայանում է «Կարաս» ապրանքանիշով:
Շաբոյանի խոսքով, «Զորահ կարասի» ապրանքային նշանը Մտավոր սեփականության գործակալության կողմից գրանցվել է 2012 թվականի մարտին, սակայն «KARASi» բառը ապրանքային նշանում հանդիսանում է չպահպանվող տարր, իսկ մի քանի ամիս անց, արդեն հունիսին նույն գործակալության կողմից գրանցվել է մյուս ընկերության՝ «Տիեռաս դե Արմենիայի» ապրանքանիշը, որտեղ նույն բառը գրանցվել է որպես պահպանվող տարր:
«Փաստորեն, խնդիրն այն է, որ «Տիեռաս դե Արմենիան» գտնում է, որ «Կարաս» բառը իրենց մտավոր սեփականությունն է և որևէ այլ ընկերություն իրավասու չէ օգտագործելու այն, քանի որ նշված բառի կիրառումը, սպառողների մոտ կարող է առաջացնել շփոթություն իրենց արտադրանքի հանդեպ»,- նշեց Ա. Շաբոյանը եւ հավելեց, որ «Զորահ կարասին» դիմումով խնդրել է, որպեսզի Հանձնաժողովը գնահատական տա, թե որքանով է պետական մարմնի, այս դեպքում Մտավոր սեփականության գործակալության կողմից կայացված որոշումը բխում մրցակցության շահերից.
«Ինչպես գիտեք, Հանձնաժողովն իրավունք ունի ընդունելու որոշումներ՝ պետական մարմինների կամ դրանց պաշտոնատար անձանց կողմից ընդունված ակտերի, այլ փաստաթղթերի՝ տնտեսական մրցակցության պաշտպանության մասին օրենսդրությանը հակասելու վերաբերյալ, ինչպես նաեւ կարող ենք դիմնել դատարան՝ պետական մարմինների կողմից ընդունված որոշումները լրիվ կամ մասնակի անվավեր ճանաչելու պահանջով: Այս պահին մեր կողմից կատարվող ուսումնասիրությունը ընթացքի մեջ է, իսկ ավարտին արդեն կներկայացնենք մեր որոշումը»,-նշեց ՏՄՊՊՀ նախագահը:
