Շիրակի դատախազը որոշել է զբաղվել Գյումրու ժամանցի կենտրոնների քրեածին վիճակը վերացնելով

ՀՀ դատախազության հանրային կապերի բաժնից Past.am-ին տեղեկացնում են, որ Շիրակի մարզի դատախազությունում ուսումնասիրվել է 2015-2017թթ. ընկած 
ժամանակահատվածում Գյումրի քաղաքում տեղակայված ժամանցի կենտրոններում 
արձանագրված պատահարների և հանցագործությունների դինամիկան։ 

Ուսումնասիրության արդյունքում պարզվել է, որ Գյումրի քաղաքում գործող 
«Մարաքեշ» և նախկին «Աուռա», ներկայում՝ «Սթար» դիսկո ակումբում բազմիցս 
արձանագրվել և շարունակում են արձանագրվել իրավախախտման և հանցագործության, այդ թվում նաև՝ դիտավորությամբ առողջությանը ծանր վնաս պատճառելու և խուլիգանության դեպքեր։


Վերջին՝ ամենաթարմ դեպքը տեղի է ունեցել դեկտեմբերի 1-ին, երբ «Սթար» 
դիսկո ակումբում քաղաքացիներից մեկը, կոպիտ կերպով խախտելով հասարակական 
կարգը, որպես զենք օգտագործվող առարկայով բռնություն էր գործադրել մեկ այլ 
քաղաքացու նկատմամբ՝ դիտավորությամբ պատճառելով գլխի վնասվածք և գանգի 
կոտրվածք:

Դեպքի առթիվ նույն օրը հարուցվել է քրեական գործ՝ ՀՀ քրեական 
օրենսգրքի 112-րդ հոդվածի 1-ին մասի և 258-րդ հոդվածի 4-րդ մասի 
հատկանիշներով։ Վարույթն իրականացնող մարմնի որոշմամբ հանցագործությունը 
կատարած անձը մի քանի այլ անձինք գործում ներգրավվել են որպես մեղադրալ։

Հատկապես գիշերային ժամերին ակումբների գործունեության ընթացքում 
արձանագրված դեպքերի հետևանքով խախտվում են քաղաքացիների անդորրն ու 
հասարակական կարգը, ինչի մասին են վկայում նաև դրանց շրջակայքում բնակվող 
քաղաքացիների բազմաթիվ դժգոհությունները:

Ընդ որում պարզվել է, որ վերը հիշատակված դիսկո ակումբներին 2015-2017 
թվականների ընթացքում՝ ժամը 24։00-ից հետո աշխատելու թույլտվություն 
քաղաքապետարանի կողմից չի տրվել, այսինքն ակումբները ժամը 24։00-ից հետո 
աշխատել են ապօրինի։

Հաշվի առնելով, որ նշված ակումբներում գիշերային ժամերին պարբերաբար տեղի 
են ունենում հանցագործություններ, այդ թվում նաև՝ ծանր, խախտվում է 
բնակչության անդորրն ու հասարակական կարգը, ըստ էության՝ առկա է քրեածին 
իրավիճակ, որը հանցագործությունների կատարմանը նպաստող պայմաններ է 
ստեղծում, ՀՀ Շիրակի մարզի դատախազ Կարեն Գաբրիելյանը հանդես է եկել 
Գյումրու քաղաքապետ Սամվել Բալասանյանին ուղղված միջնորդագրով:

Մարզի դատախազն անհրաժեշտ է համարել 2015-2017թթ. ընթացքում ժամը 24։00-ից 
հետո փաստացի ապօրինի գործունեություն ծավալելու համար նշված 
հաստատություններին օրենքով սահմանված կարգով ենթարկել վարչական 
պատասխանատվության, միջոցներ ձեռնարկել սեղմ ժամկետում դրանց հետագա 
գործունեության նպատակահարմարության հարցը լուծելու ուղղությամբ։ 

Միաժամանակ, համայնքի ղեկավարին առաջարկվել է հատկապես գործունեության 
ժամերի առումով առավել կանոնակարգել և վերահսկելի դարձնել Գյումրի քաղաքում 
գործող նմանատիպ ակումբների աշխատանքը, անհրաժեշտության դեպքում կիրառել 
համապատասխան վարչական ներգործության միջոցներ:
