2017 թ. ապրիլի 2-ի ՀՀ Ազգային ժողովի ընտրությունների ընթացքում ՀՀ ԱՆ ՔԿՀ-ներում և մարմիններում դիտորդություն իրականցնող խմբի անդամներին կամայականորեն թույլ չեն տվել մուտք գործել «Նուբարաշեն» և «Կենտրոն» ՔԿՀ-ներ: Այս մասին հայտնում է Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակը:

Դիտորդական խմբի անդամներ Արման Սահակյանն ու Հասմիկ Հարությունյանը քրեակատարողական հիմնարկներ են այցելել քվեարկության ընթացքը դիտարկելու և կալանավորված անձանց տեսակցելու նպատակով: Իմանալով, որ քվեարկության ընթացքը դիտարկելու համար անհրաժեշտ էր նախապես գրանցվել՝ դիտորդները որոշել են իրացնել միայն ՔԿՀ-ներում դիտորդի՝ իրենց իրավասությունը, սակայն դիմադրության են հանդիպել:

«Նուբարաշեն» ՔԿՀ սոցիալական, հոգեբանական և իրավական աշխատանքների բաժնի պետ Հայկ Թովմասյանը դիտորդներին արգելել է մուտք գործել ռեժիմային գոտի՝ պատճառաբանելով, որ դեպի այնտեղ տանող ճանապարհն անցնում է ընտրատեղամասի տարածքով, որտեղ ընտրական գործընթացի մասնակից չհանդիսացող անձինք չեն կարող գտնվել: Իսկ «Կենտրոն» ՔԿՀ պատասխանատու-հերթապահ Վարդան Աղաբալյանը դիտորդներին ՔԿՀ տարածք արգելել է մուտք գործել՝ պատճառաբանելով, որ ընտրություններով են զբաղված և դիտորդներին ընդունելու ժամանակ չունեն: Այնինչ՝ ՔԿՀ աշխատակիցները դիտորդների մուտքը խոչընդոտելու որևէ օրինական հիմք չեն ունեցել: Դիտորդներն իրավունք ունեն անարգել մուտք գործելու քրեակատարողական հիմնարկներ և մարմիններ, բացառությամբ այն դեպքերի, երբ քննիչը արգելանք է դրել տեսակցությունների վրա: Ինչն այս դեպքում չի եղել:

ՔԿՀ-ներում դիտորդություն իրականացնող խմբի անդամների գործունեությունը կամայականորեն խոչընդոտելու դեպքի առթիվ նույն օրը ՀՔԱ Վանաձորի գրասենյակը հանցագործության մասին հաղորդում է ներկայացրել: ՀՀ ՀՔԾ ՀԿԳ քննիչ Ն. Օսյանը բացատրություններ է վերցրել և ՔԿՀ աշխատակիցներից, և ՔԿՀ-ներում դիտորդություն իրականացնող խմբի անդամներից, սակայն ունենալով իրարամերժ տվյալներ՝  հիմնվել է միայն ՔԿՀ աշխատակիցների բացատրությունների վրա և հանցակազմի բացակայության հիմքով 2017 թ. ապրիլի 12-ին քրեական գործի հարուցումը մերժել է:

ՀՔԱ Վանաձորի գրասենյակի նախագահ Ա. Սաքունցն ու Դիտորդական խմբի անդամ Հասմիկ Հարությունյանը բողոքարկել են քննիչի որոշումը՝ հիմնավորելով, որ այն չի բխում գործով ձեռք բերված փաստական տվյալներից: ՀՀ Գլխավոր դատախազությունը մերժել է բողոքը, իսկ Արաբկիր և Քանաքեռ-Զեյթուն վարչական շրջանների ընդհանուր իրավասության դատարանը 2017 թ. նոյեմբերի 13-ին որոշել է վերացնել քննիչի որոշումն ու պարտավորեցնել ՀՀ Դատախազությանը հանցագործության մասին հաղորդման հիման վրա քրեական գործ հարուցել:

Դատարանը եզրակացրել է, որ ձեռք բերված փաստերը բավարար չեն քրեական գործ հարուցելը մերժելու համար: Վարույթն իրականացնող մարմինը բացատրություն է վերցրել միայն շահագրգիռ անձանցից և ունենալով իրարամերժ տվյալներ՝ նախապատվությունը տվել է ՔԿՀ-ների աշխատակիցների բացատրություններին՝ փոխանակ դրանք պարզելու ուղղությամբ լրացուցիչ գործողություններ ձեռնարկելու:

Դատարանի որոշմամբ՝ ՀՀ Հատուկ քննչական ծառայությունում դիտորդների աշխատանքը խոչընդոտելու դեպքի առթիվ քրեական գործ կհարուցվի:
