Երեկ շրջանառության է դրվել «Քրեակատարողական բժշկության կենտրոն» պետական ոչ առևտրային կազմակերպություն ստեղծելու մասին» կառավարության որոշման նախագիծը: Որպես նախագծի ընդունման անհրաժեշտություն է նշվում կալանավորված անձանց և դատապարտյալների պատշաճ որակով բժշկական օգնության և սպասարկման ծառայությունների մատուցումը և բժշկական անձնակազմի մասնագիտական անկախության անհրաժեշտությունը:

Արդարադատության նախարարությունը քրեակատարողական առողջապահության գործող համակարգի ինստիտուցիոնալ կառուցվածքում մի շարք համակարգային խնդիրներ է հայտնաբերել: Դրանցից են մասնագիտական անկախության բացակայությունը, բուժանձնակազմի հանդեպ ազատությունից զրկված անձանց անվստահությունը, քրեակատարողական համակարգի բուժաշխատողների ներգրավման դժվարությունն ու բժշկական անձնակազմի որակավորման խնդիրը:

Առաջինի կապակցությամբ նախագծում ասվում է, որ Արդարադատության նախարարության քրեակատարողական ծառայության բժշկական սպասարկման ստորաբաժանումները գտնվում են քրեակատարողական վարչության պետի անմիջական ենթակայության տակ, իսկ քրեակատարողական հիմնարկների բժշկական ստորաբաժանումները՝ համապատասխան քրեակատարողական հիմնարկի պետի ենթակայությամբ:

«Սրանով պայմանավորված՝ բժշկական անձնակազմի կողմից բացառապես բժշկական հարցերի շուրջ կատարած մասնագիտական եզրակացությունները կարող են ենթարկվել քրեակատարողական հիմնարկի վարչակազմի կողմից ոչ մասնագիտական վերանայման, իսկ քրեակատարողական հիմնարկի ղեկավարությունը կարող է բժիշկներին ենթարկել կարգապահական պատասխանատվության, գործնականում հավանություն չտալ բժշկական եզրակացություններին»,– կարդում ենք նախագծում:

Նախագծով սահմանվում է, որ «Քրեակատարողական բժշկության կենտրոն» պետական ոչ առևտրային կազմակերպության գործունեության առարկան է լինելու Արդարադատության նախարարության քրեակատարողական հիմնարկներում պահվող կալանավորված անձանց և դատապարտյալների առողջության պահպանումը և վերականգնումը:

Փաստաբան Տիգրան Հայրապետյանը «Փաստի» հետ զրույցում ասաց, որ միակ լուծումը, որն ամբողջ աշխարհում է կիրառվում, այն է, որ բժիշկները չպետք է քրեակատարողական վարչությունների ենթակայության տակ լինեն, իսկ թե այս նախագծով ինչ է ենթադրվում, ծանոթ չէ և չի կարող ասել՝ լավ է, թե վատ:

«Եվրոպական երկրներում, անգամ Վրաստանում է կիրառվում այն: Քրեակատարողական հիմնարկի բժիշկները չպետք է լինեն քրեակատարողական հիմնարկի անդամներ, այսինքն՝ չպետք է ենթարկվեն քրեակատարողական հիմնարկի ղեկավարությանը: Իրենք չպետք է ունենան կոչումներ, լինեն և՛ բժիշկ, և՛ արդարադատության նախարարության աշխատակից: Բժիշկը պետք է առանձին լինի և պետք է բացառապես ենթարկվի առողջապահության նախարարությանը: Անկախ նրանից, կլինեն առանձին կետեր, կամ չեն լինի, միակ լուծումը սա է. բժիշկները որևէ ձևով կախվածության մեջ չպետք է լինեն քրեակատարողական վարչությունից, որտեղ իրենք աշխատում են»,– նշեց նա:
