Պատգամավորներն առաջարկում են տուժողին տալ արագացված դատաքննության կարգ կիրառելու վերաբերյալ դիրքորոշում հայտնելու իրավունք

Ազգային ժողովի մի խումբ պատգամավորներ առաջարկում են փոփոխություն կատարել Քրեական դատավարության օրենսգրքում, որով հնարավորություն կտան տուժողին` որպես դատավարության մասնակցի,  օգտվել իր դատավարական հնարավորություններից, այն է` դիրքորոշում հայտնել արագացված դատաքննության կարգ կիրառելու վերաբերյալ: Ազգային ժողովի պետական-իրավական և մարդու իրավունքների պաշտպանության մշտական հանձնաժողովը քննարկում է պատգամավորներ Գալուստ Սահակյանի, Շուշան Սարդարյանի, Ռուստամ Մախմուդյանի, Ռաֆիկ Գրիգորյանի և Հակոբ Բեգլարյանի հեղինակած Քրեական դատավարության օրենսգրքում լրացում կատարելու մասին օրենքի նախագիծը:

Հիմնական զեկուցող, ՀՀԿ խմբակցության պատգամավոր ՌուստամՄախմուդյանն ընդգծեց, թե նախագծի ընդունումը պայմանավորված է այն հանգամանքով, որ ներկայիս իրավակարգավորումները զրկում են դատավարության մասնակից տուժողին օգտվել արագացված դատաքննության կարգ կիրառելու վերաբերյալ դիրքորոշում հայտնելու իրավունքից:

«Ընդ որում, պետք է նկատի ունենալ, որ Քրեական դատավարության մի շարք հոդվածներ անուղղակիորեն երաշխավորում են այդ իրավունքը: Չնայած ժամանակի ընթացքում Քրեական դատավարության օրենսգրքում կատարված բազմաթիվ փոփոխություններին` տուժողի` որպես դատավարության մասնակից կողմի, առաջարկները, դիտարկումները, դժգոհությունները դատաքննության արագացված կարգ կիրառելու վերաբերյալ հաշվի չեն առնվել»,- «Արմենպրես»-ի փոխանցմամբ` նշեց Մախմուդյանը:

Պատգամավորն ընդգծեց, որ ուսումնասիրել են նաև միջազգային փորձը: Նրա խոսքով` Ռուսաստանի քրեական դատավարության օրենսգիրքը ևս տուժողին տալիս է արագ դատաքննության կարգ կիրառելու վերաբերյալ դիրքորոշում հայտնելու իրավունք: «Առաջին հայացքից տպավորություն է, որ մեզ մոտ Քրեական դատավարության օրենսգրքում այս հարցը բաց է մնում և կարգավորման անհրաժեշտություն կա: Եղել են դեպքեր, երբ տուժողի դիտարկումներն ու առաջարկները հաշվի չեն առնվել արագացված դատաքննության կարգ կիրառելու կամ չկիրառելու առումով»,- մանրամասնեց Ռուստամ Մախմուդյանը:
