Բժիշկների մասնագիտական գործունեության խոչընդոտելու համար սահմանվելու է խիստ պատիժ

Ազգային ժողովի պետական-իրավական և մարդու իրավունքների պաշտպանության մշտական հանձնաժողովը դրական եզրակացություն տվեց ՀՀ Քրեական օրենսգրքում լրացում կատարելու մասին օրենքի նախագծին, որով առաջարկվում է խիստ պատիժ սահմանել բժիշկների մասնագիտական աշխատանքը խոչընդոտելու համար:

Նախագծով առաջարկվում է Քրեական օրենսգրքում ավելացնել դրույթ, որ բժշկական օգնություն և սպասարկում իրականացնող անձանց կամ բուժաշխատողների օրինական մասնագիտական գործունեությանը խոչընդոտելը պատժվում է տուգանքով նվազագույն աշխատավարձի հարյուրապատիկից երկուհարյուրապատիկի չափով: Նույն արարքը, որը կատարվել է բուժաշխատողի նկատմամբ բռնություն գործադրելով կամ դա գործադրելու սպառնալիքով պատժվում է ազատազրկմամբ` երեքից յոթ տարի ժամկետով:

Հիմնական զեկուցող, ՀՀ ԱԺ ՀՀԿ խմբակցության պատգամավոր Կարեն Ավագյանն ընդգծեց, որ խնդիրը երկար ժամանակ է, ինչ կա` շեշտելով, որ տարիներ շարունակ բուժաշխատողները նման հարցադրումներով դիմել են տարբեր պատգամավորների:«Ժամանակի ընթացքում նման նախագծերի պլան եղել է, սակայն որպես այդպիսին այն նախագիծ չի էլ դարձել: Ի՞նչ խնդիր է լուծելու այս օրենքի նախագիծը: Առաջին հերթին,  այս նախագիծը ունի կանխարգելիչ բնույթ: Բժշկի աշխատանքը չպետք խոչընդոտվի: Բժշկի աշխատանքը մենք պետք է արժևորենք նաև նմանատիպ նախագծերով, որովհետև տարիներ շարունակ այս ամենը թողնվել է մարդկանց ինքնագիտակցության վրա, և վերջին տարիներին հաճախ ենք տեսնում, որ բժիշկների աշխատանքը խոչընդոտվում է բռնությամբ: Ցավոք սրտի, նաև ունեցել ենք բժշկի մահվան դեպք, որից հետո մենք փորձեցինք հանդես գալ նման նախաձեռնությամբ»,- «Արմենպրես»-ի հաղորդմամբ` նշեց Ավագյանը:

Նրա խոսքով` եթե իրենց գործունեության ընթացքում բժիշկները սխալ են թույլ տալիս, նման արարքը քրեորեն պատժվում է: Պատգամավորն ասաց, որ առաջարկվող նախագծով նաև որոշակի հավասարության նշեն դնելն է: «Մենք այս նախագիծը նախաձեռնել ենք, որպեսզի կանխենք բժիշկների աշխատանքը բռնությամբ խոչընդոտելու դեպքերը: Այս նախագիծը հավանության է արժանացել գրեթե բոլոր բժիշկների կողմից: Տարիներ շարունակ սա մեծ խնդիր է եղել, որին մենք պետք է լուծում տանք: Ես կարծում եմ, որ այս օրենքի նախագծի ընդունից հետո մեկ-երկու նման դեպքից հետո մենք կկարողանանք զսպել բժիշկների նկատմամբ բռնության դեպքերը: Սա զսպող նախագիծ է, ոչ թե պատժող»,- մանրամասնեց Ավագյանը:
