Տնտեսական մրցակցության պաշտպանության պետական հանձնաժողովը քննության կառնի «Դիլիջան» հանքային ջրի գործարանի ապրանքային նշանը մեկ այլ ընկերության կողմից նմանակելու դեպքը։ «Արմենպրես»-ի փոխանցմամբ՝  հարցը բարձրացվեց Իջևանում ՏՄՊՊՀ-ի նախագահի և հանձնաժողովականների այցի ընթացքում, որը միտված էր տավուշցի գործարարների՝ մրցակցության ոլորտին առնչվող խնդիրներին ծանոթանալուն։ «Դիլիջան» հանքային ջրի գործարանի տնօրեն Վլադիմիր Դանիելյանը ներկաներին ցույց տվեց իրենց հանքային ջուրը դրա կողքին «Դիլիջան Ֆրոլովա» ընկերության նույնատիպ արտադրանքը՝ նշելով, որ մրցակիցը նմանակել է իրենց ապրանքային նշանը։ «Խնդրում եմ փորձանմուշների հիման վրա տեսեք, որ մեր ապրանքային նշանն են նմանակել։ Արդյո՞ք սա ընդունելի մրցակցություն է»,-հարցրեց նա։ Հանձնաժողովականների հարցին, թե, արդյոք, բողոքը ներկայացնող ընկերության ապրանքային նշանը գրանցված ու պաշտպանված է Մտավոր սեփականության գործակալությունում, տնօրենը դրական պատասխան տվեց։

«Արդեն գրանցված ապրանքային նշանի նմանությամբ մեկ այլ ապրանքային նշանն օգտագործելն անբարեխիղճ մրցակցություն է և օրենքով թույլատրված չէ։ Կխնդրենք Ձեզ օրենքով սահմանված կարգով բոլոր փաստաթղթերը մեզ ներկայացնել, մենք էլ գործին ընթացք կտանք ու լուծումներ կգտնենք»,-ասաց հանձնաժողովի անդամ Արտյոմ Հովհաննիսյանը։

ՏՄՊՊՀ նախագահ Արտակ Շաբոյանն էլ հավաստեց, որ նման հարցերը գտնվում են հանձնաժողովի իրավասության ներքո։ Նրա խոսքով՝ իրենք տարեկան տասնյակ նման դեպքեր են ուսումնասիրում։ «Մեր հիմնական ուղղություններից մեկն է անբարեխիղճ մրցակցային դրսևորումների դեմ պայքարը, երբ տնտեսվարողները նմանակում են ապրանքային նշաններ ու այդ ճանապարհով շփոթություն ու մոլորություն առաջացնում սպառողների շրջանում։ Այս դեպքում առերևույթ անբարեխիղճ մրցակցության դրսևորման երևույթ է առկա, ու մենք անպայման այս գործը կուսումնասիրենք ու որոշում կկայացնենք»,-վստահեցրեց ՏՄՊՊՀ նախագահը։

Հանձնաժողովը կհավաքագրի համապատասխան փաստաթղթերը, կլսի նաև մյուս կողմի պարզաբանումները և ապա որոշում կկայացնի։
