ՀՀ ՔԿ-ն մեղադրանք է առաջադրել երեխային պատանդ վերցնելու և երկու անձի նկատմամբ սպանության փորձի համար

 ՀՀ քննչական կոմիտեի Արմավիրի մարզային քննչական վարչությունում քննվող քրեական գործով Արմավիրի բնակչին մեղադրանք է առաջադրվել՝ դանակի գործադրման սպառնալիքով ակնհայտ անչափահասին պատանդ վերցնելու, երկու անձանց նկատմամբ սպանության փորձ կատարելու համար: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեից՝ հավելելով. «Արմավիրի մարզային քննչական վարչությունում շարունակում են կատարվել անհրաժեշտ քննչական գործողություններ՝ Արմավիրում գործող «Մանուշակ» մանկապարտեզում հոկտեմբերի 30-ին տեղի ունեցած դեպքի բոլոր հանգամանքները պարզելու ուղղությամբ։ Հաշվի առնելով քրեական գործի նկատմամբ հասարակական մեծ հետաքրքրությունը՝ ներկայացնում ենք որոշ տվյալներ՝ նախաքննության այս փուլում պարզված հանգամանքների վերաբերյալ։

Այսպես՝ ըստ նախնական քննության տվյալների՝ 2017թ. հոկտեմբերի 30-ին՝ ժամը 16:00-ի սահմաններում, Արմավիրի բնակիչը գնացել է «Մանուշակ» մանկապարտեզ, որտեղ կինը աշխատում է որպես դաստիարակչուհի՝ պահանջելով դուրս գալ՝ պատճառաբանելով, թե նրա հետ ցանկանում է առանձնազրույց ունենալ: Կինը հրաժարվել է կատարել տղամարդու  պահանջը, ինչից հետո վերջինս հանել է դանակը և բռնություն գործադրելով՝ քարշ տալով, փորձել է նրան դուրս բերել շենքից։

Նախնական քննությամբ բավարար փաստական տվյալներ են ձեռք բերվել, որ տղամարդը դանակը դրել է կնոջ պարանոցին՝ փորձելով հարվածել, սակայն վերջինս բռնել է շեղբից, ապա նրանց է մոտեցել մանկապարտեզի տնօրենը։ Ենթադրյալ հանցագործություն կատարած անձը դանակով հարվածել է տնօրենին, որի հետևանքով վերջինս վնասվածք է ստացել պարանոցի և ականջի հատվածում, այնուհետև փորձել է կնոջը բռնությամբ տանել մանկապարտեզի ննջասենյակներից մեկը, սակայն օգնության հասած ազգականը հարվածել է տղամարդուն, ինչի հետևանքով կնոջը հաջողվել է դիմել փախուստի՝ ստանալով մարմնական վնասվածքներ: Ժամը 16։30-ի սահմաններում տղամարդը պատանդ է վերցրել մանկապարտեզի ննջասենյակում գտնվող ակնհայտ անչափահասին՝ մանկահասակ երեխային՝ նրան ազատ արձակելու համար իրավապահ մարմիններից պահանջելով հանդիպում կազմակերպել իր նախկին կնոջ հետ։

Ձեռնարկված միջոցառումների արդյունքում հաջողվել է ժամը 20-ի սահմաններում վնասազերծել տղամարդուն և անվնաս ազատել փոքրիկին։

Ձեռք բերված բավարար ապացույցների հիման վրա՝ քննիչը որոշում է կայացրել տղամարդուն մեղադրանք առաջադրել՝ ՀՀ քրեական օրենսգրքի 34-104-րդ հոդվածի 2-րդ մասի 1-ին կետով և 218-րդ հոդվածի 2-րդ մասի 3-րդ և 4-րդ կետերով: Միջնորդություն է ներկայացվել դատարան՝ նրա նկատմամբ որպես խափանման միջոց կալանավորումն ընտրելու վերաբերյալ։

Նախաքննությունը շարունակվում է:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով»:
