ԱԺ-ն ընդունեց թմրամիջոցների և հոգեմետ նյութերի չափերը հստակեցնող օրինագիծը

Հայաստանի Ազգային ժողովն առաջին ընթերցմամբ ընդունեց ՀՀ «Քրեական օրենսգրքում» փոփոխություններ և լրացումներ կատարելու մասին և հարակից նախագծերի օրենսդրական փաթեթը: Ինչպես հաղորդում է «Արմենպրես»-ը, օրենսդրական փաթեթն առաջին ընթերցմամբ ընդունելու հարցին կողմ քվեարկեց 63, դեմ՝ 10, ձեռնպահ՝ 25 պատգամավոր:
Քվեարկությունից առաջ վարման կարգի վերաբերյալ ձայնի իրավունք խնդրեց «Ելք» խմբակցության պատգամավոր Արտակ Զեյնալյանը, ով հայտնեց, որ իրենք օրենսդրական փաթեթում իրավական որոշակիության հետ կապված խնդիր են տեսնում, ուստի դեմ են քվեարկելու:
Թմրամիջոցների և հոգեմետ դեղերի նոր տեսակների ի հայտ գալու հանգամանքով պայմանավորված՝ ոստիկանության կողմից յուրաքանչյուր տարի նախապատրաստվում և կառավարության քննարկմանն է ներկայացվում քրեական և վարչական իրավախախտումների վերաբերյալ օրենսգրքերի հավելվածներով հաստատված ցանկերում փոփոխություններ կամ լրացումներ նախատեսող նախագծեր: Նախագծերի շրջանառությունից մինչև դրանց ընդունումն ընկած ժամանակային տևողությունը լուրջ խնդիրներ է առաջացնում վերջիններիս նոր տեսակների ապօրինի շրջանառությունը կանխարգելելու իմաստով: Նշված խնդիրների լուծման նպատակով քննարկվել և մշակվել է թմրամիջոցների և հոգեմետ դեղերի չափերը ենթաօրենսդրական ակտով սահմանելու հարցը: Այդ ուղղությամբ ուսումնասիրվել է միջազգային փորձը, անցկացվել են խորհրդակցություններ: Խորհրդակցությունների արդյունքներն ամփոփվել են ոստիկանության կողմից հաստատված և ձեր քննարկմանը ներկայացված օրինագծում:
Ներկայացված փաթեթով առաջարկվում է ուժը կորցրած ճանաչել օրենսգրքով հաստատվող հավելվածները և դրանք սահմանել կառավարության որոշմամբ: Բացի այդ, նախագծով նոր մոտեցում է որդեգրվել թմրամիջոցների և հոգեմետ նյութերի չափերը որոշելու հարցում: Մասնավորապես, «Վարչական իրավախախտումների վերաբերյալ» օրենսգրքով սահմանվելու է, որ թմրամիջոցների և հոգեմետ նյութերի մանր չափեր են համարվելու անսովոր գործածողի, այսինքն՝ թմրամիջոցներ, հոգեմետ նյութեր, ինչպես նաև խիստ ներգործող նյութեր չգործածող 18 տարին լրացած և գործնականում առողջ, այսինքն՝ միջին վիճակագրական անձի օրգանիզմի վրա հոգեներգործության ազդեցություն թողնելու համար բավարար թմրամիջոցների և հոգեմետ նյութերի նվազագույն չափերից մինչև դրանց հնգապատիկը ներառող չափերը: Քրեական օրենսգրքում նախատեսվող փոփոխություններով զգալի և խոշոր և առանձնապես խոշոր չափեր են համարվելու թմրամիջոցների և հոգեմետ նյութերի մանր չափերի նվազագույն շեմի, համապատասխանաբար, հնգապատիկից մինչև քսանհինգապատիկը ներառող, քսանհինգապատիկից մինչև հարյուր քսանհինգապատիկը ներառող և հարյուր քսանհինգապատիկը գերազանցող չափերը:
