Ադրբեջանը հրաժարվել է ենթարկվել ՄԻԵԴ վերջնական որոշմանը. ԵԽ նախարարների կոմիտեն բացատրություն է պահանջում

Եվրոպայի խորհրդի նախարարների կոմիտեն պաշտոնապես դիմել է Ադրբեջանին`պահանջելով բացատրել, թե ինչու կյանքի չի կոչվել Մարդու իրավունքների եվրոպական դատարանի (ՄԻԵԴ) վճիռը ադրբեջանցի ընդդիմադիր գործիչ Իլգար Մամեդովի գործով: Ինչպես հաղորդում է «Արմենպրես»-ը, այս մասին հայտնում է Եվրոպայի խորհրդի պաշտոնական կայքը:
ԵԽ նախարարների կոմիտեն հիշեցրել է, որ համաձայն Մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության կոնվենցիայի 46-րդ հոդվածի երկրորդ կետի՝ կոմիտեն հսկում է Մարդու իրավունքների եվրոպական դատարանի վերջնական վճիռների կատարումը:
Անդրադառնալով ՄԻԵԴ որոշմանը՝ կոմիտեն հիշեցրել է, որ Եվրոպական դատարանը համարել է, որ Մամեդովի կալանավորմամբ Ադրբեջանը խախտել է վերոնշյալ կոնվենցիայի մի շարք դրույթներ՝ կապված ընդդիմադիր գործչի ձերբակալման, մինչդատական կալանքի հետ: Դատարանը վճռել էր, որ Մամեդովի դեմ ադրբեջանական կողմի ձեռնարկած միջոցները նպատակ են ունեցել լռեցնել նրան, պատժել կառավարության գործունեության քննադատության համար:
Կոմիտեն հիշեցրել է, որ համաձայն կոնվենցիայի 46-րդ հոդվածի՝ պատասխանող կողմ հանդիսացող պետությունը պետք է ենթարկվի այն դատական գործերի բոլոր որոշումներին, որոնց տվյալ երկիրը ներգրավված է որպես կողմ: Համաձայն այդ պարտավորության՝ տվյալ երկիրը պետք է ձեռնարկի բոլոր անհրաժեշտ քայլերը արձանագրված խախտումները վերացնելու նպատակով: Որպես անհրաժեշտ քայլ Ադրբեջանը պարտավորվել էր ազատ արձակել Մամեդովին, ով, սակայն, շարունակում է մնալ անազատության մեջ:
Նախարարների կոմիտեն արձանագրել է, որ, Մամեդովին անհապաղ ազատ չարձակելով, Ադրբեջանը հրաժարվել է ենթարկվել ՄԻԵԴ վերջնական որոշմանը: Հետևաբար, ՄԻԵԴ-ը պաշտոնապես դիմել է ադրբեջանական կողմին՝ հայտնելով, որ դեկտեմբերի 5-ին կայանալիք 1302-րդ հանդիպմանը դիմելու են դատարան՝ առաջ քաշելու Ադրբեջանի կողմից պարտականությունների կատարման ձախողման հարցը: Այս կապակցությամբ նախարարների խորհուրդը Ադրբեջանից նաև պահանջել է մինչև նոյեմբերի 29-ը ներկայացնել իր կողմի տեսակետը հարցի առնչությամբ:
ՄԻԵԴ-ը 2014 թվականի մայիսի 22-ին որոշում էր կայացրել այն մասին, որ ադրբեջանցի ընդդիմադիր գործիչ Իլգար Մամեդովի ձերբակալությունն ու կալանավորումը արդարացված չեն: Դատարանն Ադրբեջանից պահանջել էր ոչ միայն ազատ արձակել գործչին, այլև 22 հազար եվրոյի չափով փոխհատուցում վճարել նրան: Մամեդովը մինչ օրս գտնվում է բանտում:
