Առանձնապես խոշոր չափերով հարկի վճարումից խուսափելու դեպքի առթիվ ՀՀ գլխավոր դատախազությունում քրգործ է հարուցվել

ՀՀ գլխավոր դատախազության կոռուպցիոն և տնտեսական գործունեության դեմ ուղղված հանցագործությունների գործերով վարչության պետի տեղակալի կողմից  քրեական գործ է հարուցվել հարկի հաշվարկում ակնհայտ կեղծ տվյալ մտցնելու միջոցով առանձնապես խոշոր չափերով հարկի վճարումից խուսափելու դեպքի առթիվ: 

Ինչպես «Արմենպրես»-ին տեղեկացրին Երևանի քաղաքապետարանի տեղեկատվության և հասարակայնության հետ կապերի վարչությունից, ՀՀ ԿԱ ՊԵԿ իրավախախտումների հայտնաբերման ու վարչական վարույթների իրականացման վարչությունում նախապատրաստված նյութերով պարզվել է, որ Արմավիրի մարզի Փարաքար-Թաիրով համայնքում գտնվող առևտրի օբյեկտ հասարակական նշանակության գույքը ֆիզիկական անձի կողմից օտարվել է 40 մլն ՀՀ դրամ պայմանագրային արժեքով: Մինչդեռ ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեից ստացված տեղեկությունների համաձայն նշված գույքի գույքհարկով հարկման նպատակով որոշվող արժեքը կազմել է 254 396 203 ՀՀ դրամ: 

Հիշյալ գործարքի մասով ավելացված արժեքի հարկի 2017 թվականի 1-ին եռամսյակի հաշվարկում արտացոլվել է 43 650 000 ՀՀ դրամի շրջանառություն, որի արդյունքում հաշվարկվել է 8 730 000 ՀՀ դրամի ավելացված արժեքի հարկ: Սակայն ՀՀ ԿԱ ՊԵԿ փոքր հարկ վճարողների հարկային տեսչության վերլուծության թիվ 1 բաժնի աշխատակիցների կողմից կազմված տեղեկանքի համաձայն «Ավելացված արժեքի հարկի մասին» ՀՀ օրենքի հիման վրա վերոգրյալ գործարքի արդյունքում 2017 թվականի 1-ին եռամսյակի հիշյալ հաշվարկում պակաս է ներկայացվել 152 396 203 ՀՀ դրամի հարկվող շրջանառություն և 30479241 ՀՀ դրամի ավելացված արժեքի հարկ: Հիշյալ գործարքից առաջացող  առանձնապես խոշոր չափերով հարկը չվճարելու նպատակով 2017 թվականի 1-ին եռամսյակի ավելացված արժեքի հարկի հաշվարկում մտցվել է ակնհայտ կեղծ տվյալ: 

Հաշվի առնելով նշված փաստական հանգամանքները՝ ՀՀ գլխավոր դատախազության կոռուպցիոն և տնտեսական գործունեության դեմ ուղղված հանցագործությունների գործերով վարչության պետի տեղակալի կողմից հիշյալ դեպքի առթիվ ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի 2-րդ մասով հարուցվել է քրեական գործ: 

Նախաքննություն կատարելու համար քրեական գործն ուղարկվել  է ՀՀ ԿԱ պետական եկամուտների կոմիտեի քննչական վարչություն: 

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
