ԱԺ-ն մերժեց մեղադրյալի և կասկածյալի հարցաքննությունը տեսաձայնագրելու մասին նախագիծը լիագումար նիստերի օրակարգ ընդգրկելու հարցը

Ազգային ժողովը քվեարկությամբ մերժեց քրեական գործով անցնող կասկածյալի և մեղադրյալի հարցաքննությունը տեսաձայնագրելու մասին օրենսդրական նախաձեռնությունը խորհրդարանի լիագումար նիստերի օրակարգ ընդգրկելու հարցը: Քրեական դատավարության օրենսգրքում փոփոխություն կատարելու մասին օրենքի նախագիծն Ազգային ժողովի նիստերի լիագումար նիստերի օրակարգ ընդգրկելու մասին հարցին կողմ քվեարկեց 34, դեմ՝ 51, ձեռնպահ՝ 6 պատգամավոր:
Օրենսդրական նախաձեռնության համահեղինակ, «Ծառուկյան» խմբակցության պատգամավոր Նաիրա Զոհրաբյանն ընդգծեց, որ մեղադրյալի և կասկածյալի հարցաքննությունը տեսաձայնագրելու դրույթը Եվրոպայի խորհրդի խոշտանգումների կանխարգելման հանձնաժողովի հիմնական պահանջներից մեկն է: «Ես հիշեցնեմ նաև, որ Եվրոպական դատարանը Հայաստանի վերաբերյալ խոշտանգումների կանխարգելման և արդար դատավարություն իրականացնելու որոշում է կայացրել, որտեղ հստակ արձանագրվում է, որ կասկածյալի և մեղադրյալի հարցաքննությունները տեղի են ունենում կոպտագույն խախտումներով: Հիմա ի՞նչն է խանգարում, որ մենք քննարկման առարկա դարձնենք այս հարցը: Խորհրդարանական մեծամասնությանը խորհուրդ եմ տալիս գոնե մեկ անգամ չենթարկվել կառավարության մոտեցմանը»,- «Արմենպրես»-ի փոխանցմամբ՝ընդգծեց Զոհրաբյանը:
Ազգային ժողովի պետական-իրավական և մարդու իրավունքների պաշտպանության մշտական հանձնաժողովի անդամ Գևորգ Կոստանյանը նշեց, որ հասկանում է նախագծի նպատակը՝ մեղադրյալի և կասկածյալի հարցաքննության տեսաձայնագրությունն է: «Հիմա հարց է առաջանում՝ ինչո՞ւ միայն մեղադրյալի և կասկածյալի: Ապացուցողական բազայի 90 տոկոսը ձևավորում են վկաներն ու տուժողները: Եթե մենք խոսում ենք այն մասին, որ պատշաճ ապացուցողական բազա ձևավորվի առանց խոշտանգումների կամ այլ միջամտությունների, թող տեսաձայնագրվեն և՛ տուժողների, և՛ վկաների, և՛ կասկածյալների և՛ մեղադրյալների հարցաքննությունները: Խնդիրն այն է, որ տեսաձայնագրությունը, որպես ապացույց, օգտագործելն ինքնին կաշկանդում է ցուցմունք տվող սուբյեկտին: Այսինքն՝ այն սուբյեկտը, ով նախաքննության սկզբնական փուլում տեսաձայնագրությամբ ցուցմունք է տվել, նախաքննության հետագա փուլերում կաշկանդված է լինելու սկզբնական փուլում իր իսկ տված ցուցմունքներով»,- ասաց Կոստանյանը:
Նա հավելեց, որ շատ երկրներ սկսել են հրաժարվել ցուցմունքների տեսաձայնագրություններից, քանի որ այդ նույն ճնշումները, որոնք գործադրվում են ցուցմունք վերցնելու համար, մինչև տեսաձայնագրությունն են կիրառվում: «Ցուցմունքը տեսաձայնագրելը քրեադատավարական տեսանկյունից չի համարվում արդյունավետ միջոց»,- եզրափակեց Գևորգ Կոստանյանը:
