ՀՀ-ում արտակարգ դրություն հայտարարելու լիազորությունը կվերապահվի կառավարությանը

 Հայաստանում սահմանադրական կարգի ապահովմանը սպառնացող վտանգի դեպքում արտակարգ դրություն հայտարարելու լիազորությունը երկրի նախագահի փոխարեն կվերապահվի կառավարությանը:  Հայաստանի Ազգային ժողովի պետական-իրավական և մարդու իրավունքների պաշտպանության մշտական հանձնաժողովը դրական եզրակացությամբ խորհրդարանի նստաշրջանի օրակարգում ընդգրկեց «Արտակարգ դրության իրավական ռեժիմի մասին» օրենքում փոփոխություններ կատարելու մասին օրենքի նախագիծը:

Հիմնական զեկուցող, ՀՀ ոստիկանության պետի տեղակալ Վարդան Եղիազարյանը հստակեցրեց, որ սահմանադրական բարեփոխումներից հետո ՀՀ նախագահի որոշ լիազորություններ փոխանցվել են պետական այլ մարմինների: «Մասնավորապես, նոր Սահմանադրության 120-րդ հոդվածի համաձայն` սահմանադրական կարգին սպառնացող անմիջական վտանգի դեպքում արտակարգ դրություն հայտարարելու լիազորությունը հանրապետության Նախագահի փոխարեն վերապահվում է կառավարությանը: Նշված դրույթը ուժի մեջ կմտնի հանրապետության նորընտիր Նախագահի կողմից պաշտոնն ստանձնելու օրը»,- «Արմենպրես»-ի փոխանցմամբ` մանրամասնեց Եղիազարյանը:

Նա հավելեց, որ ներկայացված նախագծի նպատակն է օրենքով ամրագրել կառավարության կողմից արտակարգ դրության հայտարարելու վերաբերյալ իրավակարգավորումները, ինչպես նաև հստակեցնել պետական այլ մարմինների դերը և լիազորությունները արտակարգ դրության իրավական ռեժիմի ապահովման գործում: «Մասնավորապես, նախագծով արտակարգ դրություն հայտարարելու, արտակարգ դրության դադարեցման, արտակարգ դրության տարածքում պետական կառավարման հատուկ մարմին ստեղծելու իրավասությունը վերապահվում է Հայաստանի Հանրապետության կառավարությունը»,- ընդգծեց Վարդան Եղիազարյանը:

Հանձնաժողովի անդամները միաձայն կողմ քվեարկեցին նախագծին դրական եզրակացություն տալու հարցին:
