«Փաստ» օրաթերթը գրում է.

Օրերս, ԵՊՀ Սահմանադրական իրավունքի ամբիոնի վարիչ, Արդարադատության նախկին նախարար Գևորգ Դանիելյանը ֆեյսբուք սոցիալական ցանցի իր միկրոբլոգում հետևյալ տեսակետն է հայտնել «Դատախազության մասին» նոր օրենքի նախագծի մասին:

«ԱԺ ներկայացված «Դատախազության մասին» ՀՀ օրենքում փոփոխություններ նախատեսող օրինագծի համաձայն գլխավոր դատախազ կարող է լինել միայն քրեական դատավարության մասնագետը: Իսկ ինչո՞ւ միայն այդ, գուցե հա՞րկ է նաև գրել, թե ինչ գույնի մազեր պետք է ունենա, կամ պե՞տք է ունենա, թե ոչ, ծնունդով որտեղից պետք է լինի: Ո՞նց ժամանակին չեն կռահել այսպես վարվել, չէ՞ որ հնարավոր կլիներ կանխել այնպիսի «ոչ մասնագետների» գլխավոր դատախազ լինելը, որպիսիք էին Հենրիկ Խաչատրյանը, Արտավազդ Գևորգյանը, Վլադիմիր Նազարյանը, Աղվան Հովսեփյանը և այլք: Հետաքրքիր ժամանակներում ենք ապրում: Հիշեցի ռուսական անեկդոտը, որը սպառնում է իրողություն դառնալ. թեկնածուական ատենախոսությունը երկար գրված դիմում է՝ աշխատավարձը բարձրացնելու մասին...»:

Հարցը թեև խիստ մասնագիտական է, սակայն հետաքրքիր է իմանալ, թե իրականում ինչու է այդքան կարևոր, որ գլխավոր դատախազի պաշտոնում միայն քրեական իրավունքի մասնագետը նշանակվի:

Փաստաբան Նիկոլայ Բաղդասարյանը «Փաստի» հետ զրույցում անդրադառնալով դատախազության լիազորություններին նշեց, որ ՀՀ գլխավոր դատախազությունը թեև տարբեր գործառույթներ է իրականացնում՝ դատարաններում պետական շահն է ներկայացնում և պաշտպանում, սակայն հիմնական գործառույթը քրեական հետապնդում իրականացնելն է:

«Կառավարության որոշմամբ նախատեսված դեպքերում, երբ պետությունը գույքային վնաս է կրում, դատախազությունը կարող է հայց ներկայացնել: Ընդ որում, կարող է հանդես գալ նաև որպես պատասխանող, սակայն դատախազության հիմնական գործառույթը քրեական գործառույթ իրականացնելն է: Հետևաբար, կարծում եմ, որ յուրաքանչյուր բնագավառ ներկայացնող կառույց պետք է տվյալ ոլորտի մասնագետը ղեկավարի: Այսինքն, եթե խոսքը բժշկական հաստատության մասին է, ապա ղեկավարը պետք է բժիշկ լինի: Եվ եթե տվյալ կլինիկան բացառապես զբաղվում է գենետիկայի ուսումնասիրությամբ, ապա տվյալ կլինիկայի ղեկավարը պետք է գենետիկայի մասնագետ լինի: Դատախազության դեպքում ղեկավարը պետք է իրավաբան լինի, ընդ որում՝ քրեական իրավունքի մասնագետ»,– ասաց Ն. Բաղդասարյանը:

Հարցին, թե այդ պարագայում, ինչու է հիմա տարածվել այն տեսակետը, որ եթե մարդը լավ մենեջեր է, ապա կապ չունի, թե ինչ մասնագիտություն ունի, ցանկացած կառույց էլ կարող է արդյունավետ ղեկավարել, փաստաբանն ասաց.

«Եթե խոսքը կոնկրետ մասնագիտացված կառույցի ղեկավարի մասին է, ապա միայն լավ մենեջեր լինելը բավարար չէ: Բնական է, որ նա պետք է նաև տիրապետի մասնագիտական այն նեղ ոլորտին, որով զբաղվում է տվյալ կառույցը, որպեսզի կարողանա արդյունավետ ղեկավարել այն: Այսինքն, լավ մենեջեր լինելու հանգամանքը պայմանավորված է նաև նրանով, թե որքանով տվյալ անձը լավ գիտելիք ունի տվյալ ոլորտի մասին: Օրինակ, եթե ես բժշկական կրթություն չունեմ, ապա չեմ կարող բժշկական հաստատության լավ ղեկավար լինել, քանի որ չեմ տիրապետում տվյալ մասնագիտությանը: Եվ հակառակը: Նույնն էլ դատախազական համակարգին է վերաբերում»,– ասաց Ն. Բաղդասարյանը:
