Անկախության 26 տարվա ընթացքում արդարադատության ոլորտում ոչինչ չի փոխվել, բոլորը կոսմետիկ փոփոխություններ են:
Այս մասին Tert.am-ի հետ զրույցում ասաց փաստաբան Երվանդ Վարոսյանը` պատասխանելով հարցին, թե ինչ նշանակալի փոփոխություններ են եղել անկախության տարիներին Հայաստանում իրավական տեսանկյունից:
«Դատավորները սև պատմուճան հագան, օրենսգրքերի վրա գրվեց Հայաստանի հանրապետության, ոստիկանության ուսադիրները փոխվեցին, համազգեստն էլ մի քանի անգամ փոխվեց, դատական համակարգը դարձավ եռաստիճան, որից ոչինչ չփոխվեց:
Մտածելակերպը նույնն է, օրենքի նկատմամբ վերաբերմունքը նույնն է: Մինչև մտածելակերպը չփոխվի, ոչինչ չի փոխվի, որքան ուզում ես ձևական փոփոխություններ կատարիր ու անունը դիր բարեփոխում»,-ասաց Վարոսյանը:
Փաստաբանի խոսքով՝ երբ մի օր օրենքը դառնա բոլորի համար նույնը և բոլորը դառնան օրենքի առաջ հավասար, օրենքը կկիրառվի բոլոր հանդեպ այնպես, ինչպես օրենքի պահանջն է, այդ ժամանակ Հայաստանում տեղի կունենան բոլոր անհրաժեշտ փոփոխությունները. «Մինչ դա մենք կանենք կոսմետիկ բարեփոխումներ, տարբեր ձևական զեկույցներ, ամպագորգոռ ճառեր իբր առաջընթացի մասին: Դատական առումով եթե մի քանի դրական կետերը մի կողմ թողնենք, որևէ բան չի փոխվի, բայց եթե այդ կետերը տևական ժամանակ մնան կետեր, դրանք էլ են վերանալու»:
Հարցին, թե որ կետերն են դրական, Երվանդ Վարոսյանը պատասխանեց. «Կոնկրետ մարդիկ՝ դատավորները, ովքեր կոռումպացված չեն և նրանց մասին բոլորը գիտեն։ Ամեն ինչ պայմանավորված է քաղաքական կամքով և մարդկային գործոնով»:
Դիտարկմանը, թե սահմանադրական փոփոխությունները երկրում ոչինչ չեն փոխել, Երվանդ Վարոսյանն արձագանքեց, որ սահմանադրական փոփոխությունները Հայաստանում ոչինչ չեն փոխել:
«1995 թվականի սահմանադրության պայմաններում, եթե լիներ նորմալ իրավական պետություն` քաղաքական կամք ունեցող, մենք կունենայինք նորմալ իրավական պետություն և դրանից հետո երկու անգամ հավելյալ սահմանադրական փոփոխություններ իրականացնելու կարիք չէր լինի: Մյուս տեսակետից էլ ասեմ, որ եթե կամք չկա, 1500 անգամ էլ փոխենք սահմանադրությունը, ոչինչ չի փոխվի»,-ասաց Վարոսյանը:
