«Ազատություն» ռադիոկայանի ադրբեջանական ծառայությունը որոշել է դիմել ՄԻԵԴ

«Ազատություն» ռադիոկայանի ադրբեջանական ծառայությունը որոշել է Ադրբեջանական կառավարության դեմ հայց ներկայացնել Մարդու իրավունքների եվրոպական դատարան (ՄԻԵԴ): 

Այս մասին, ինչպես հաղորդում է «Արմենպրես»-ը, հայտնում է ադրբեջանական «Թուրան» լրատվական գործակալությունը:

«Ազատության»  հայցը կապված է լինելու շուրջ 3 տարի շարունակ Ադրբեջանի կառավարության կողմից ռադիոկայանի բնականոն աշխատանքներին խոչնդոտելու հետ: 

«Մենք չկարողացանք հասնել նրան, որպեսզի վերացվեն Ադրբեջանի արդարադատության կողմից մեր դեմ հարուցված մեղադրանքները: Այդ մեղադրանքներն անհիմն են, և հաշվի առնելով, որ Մարդու իրավունքների եվրոպական դատարանն իրավասու է Ադրբեջանի վերաբերյալ վճիռներ կայացնել, որոշեցինք դիմել ՄԻԵԴ»,- նշել է ռադիոկայանի ներկայացուցիչ Թոմաս Կենտը: 

Ադրբեջանի իրավապահ մարմինները 2014-ին կատարված ստուգումների արդյունքում «Ազատություն» ռադիոկայանի ադրբեջանական ծառայության նկատմամբ հարուցել էին մի շարք գործեր հարկային պարտականությունները պատշաճ չկատարելու մեղադրանքներով: «Ազատություն» ռադիոկայանը դրանից հետո բազմից հայտարարել է, որ այդ մեղադրանքներն անհիմն են: 

«Ռադիոկայանը կիրառել է Ադրբեջանի արդարադատության համակարգում հնարավոր բոլոր ջանքերը, որպեսզի հանվեն այդ անհիմն մեղադրանքները, սակայն ապարդյուն. Ադրբեջանի կառավարությունը շարունակում է պահպանել դրանք»,- ասել է նա: 

ՄԻԵԴ ներկայացվելիք հայցում բարձրացվելու են կառույցի իրավունքների ոտնահարման խնդիրները, որոնք ամրագրված են 6.1 «Արդար դատաքննության իրավունք»  և 13-րդ  «արդյունավետ իրավական միջոցների իրավունք» հոդվածներով: 

Հարկային պարտականությունները պատշաճ չկատարելու անհիմն մեղադրանքներից բացի՝ Ադրբեջանի կառավարությունը 2017-ի գարնանը արգելափակել է «Ազատություն» ռադիոկայանի ինտերնետային կայքը: 

Ռադիոկայանի կայքի առգելափակումը ադրբեջանական կառավարությունը հիմնավորել է ազգային անվտանգության դեմ ուղղված սպառնալիքների վերացմանն ուղղված  գործողություններով  և կայքում ծայրահեղական նյութերի հրապարակման հանգամանքով: 

Ռադիոկայանը կայքի արգելափակման հետ կապված դիմել է դատարան, սակայն վարույթ դեռևս չի սկսվել: 

Մարտի 27-ին azadliq.info լրատվական գործակալությունը հայտնել է, որ արգելափակվել են ադրբեջանական «Ազատություն» թերթի, «Ազատություն» ռադիոկայանի և meydan.tv-ի կայքերը:

Գործակալությունը նշել էր, որ այս կայքերն արգելափակվել են միայն Ադրբեջանի տարածքում, իսկ Ադրբեջանի սահմաններից դուրս օգտատերերը կարողանում են օգտվել կայքերից:

Ադրբեջանի իշխանությունները շարունակական հետապնդումների են ենթարկում, ինչպես ընդդիմադիր գործիչներին և լրագրողներին, այնպես էլ ընդդիմադիր գործունեություն ծավալող և իշխանությունների ապօրինությունները մերկածցնող ԶԼՄ-ներին, այդպիսով ցանկանալով երկրում լռեցնել այլակարծությունը և իշխանություններին հակասող ցանկացած կարծիք:
