 ՀՀ հատուկ քննչական ծառայությունում կատարված նախաքննությամբ ձեռք բերված բավարար ապացույցներով հիմնավորվել է, որ Հարություն Խաչատրյանը, 2016թ.-ին զբաղեցնելով Երևանի քաղաքապետարանի առևտրի և սպասարկումների վարչության առաջին կարգի մասնագետի պաշտոնը, խարդախության եղանակով Երևանի բնակիչ Լ. Մ.-ից հափշտակել է խոշոր չափերով` ավելի քան 4.000 ԱՄՆ դոլար գումար: Այս մասին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:

Այսպես, Հ. Խաչատրյանը, տեղեկանալով, որ հիշյալ քաղաքացին ցանկանում է սեփականաշնորհել փաստացի իրեն պատկանող կրպակը, նրան վստահեցրել է, թե, իբր, որպես քաղաքապետարանի աշխատակից կարող է իրականացնել ինքնակամ կառույցի օրինականացման գործընթացը, թեպետ իրականում նման լիազորություններով օժտված չի եղել: Այդ նպատակով Հ. Խաչատրյանը 2016թ. դեկտեմբերի 21-ին հանդիպել է Լ. Մ.-ին և նշված կրպակի պետական գրանցման գործընթացի համար անհրաժեշտ վճարումներ կատարելու պատրվակով` նրանից վերցրել 1.922.720 ՀՀ դրամին համարժեք 4000 ԱՄՆ դոլար գումար, միաժամանակ պայմանավորվածություն է ձեռք բերվել մնացած գումարն ավելի ուշ փոխանցելու շուրջ:

2017թ.-ին աշխատանքի անցելով ՀՀ ԿԱ պետական եկամուտների կոմիտեում` Հ. Խաչատրյանը շարունակել է հանցավոր մտադրության իրագործումը. կրկին հանդիպել է Լ. Մ.-ին և առանց վերջինիս հայտնելու, որ ազատվել է համայնքային ծառայողի պաշտոնից, վստահեցրել է, որ կրպակի պետական գրանցման գործընթացն արդեն ընթացքի մեջ է, սակայն այն ավարտին հասցնելու և վերջնական վճարումները կատարելու համար անհրաժեշտ է ևս 130.000 ՀՀ դրամ: Հ. Խաչատրյանը քաղաքացուն հավաստիացրել է, որ կարճ ժամանակահատվածում կիրականացնի հիշյալ գործընթացը` խոստանալով հակառակ դեպքում ամբողջությամբ վերադարձնել գումարը, սակայն ստանձնած պարտավորությունները կատարելու ուղղությամբ որևէ գործողություն չի կատարել և գումարը հետ չի վերադարձրել, այլ խարդախությամբ հափշտակել  է այն:

Այսպիսով, վերը նշված հանցավոր արարքի կատարման համար Հարություն Խաչատրյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի 2-րդ մասի 2-րդ կետով: Հ. Խաչատրյանի վերաբերյալ քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին` այն հաստատելու և դատարան ուղարկելու համար:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
