Ուժի մեջ են մտել ՀՀ աշխատանքային օրենսգրքում կատարված փոփոխությունները

«Հայաստանի Հանրապետության աշխատանքային օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին» ՀՀ օրենքը հոկտեմբերի 22-ից մտել է ուժի մեջ: Ինչպես«Արմենպրես»-ին հայտնեցին ՀՀ աշխատանքի և սոցիալական հ արցերի նախարարության հասարակայնության հետ կապերի բաժնից, օրենքով կարգավորվել են իրավակիրառ պրակտիկայում ի հայտ եկած մի շարք խնդիրներ: Մասնավորապես, փոփոխությունների արդյունքում ամբողջական ձևակերպմամբ սահմանվել է «հատուկ կամ մասնագիտական աշխատանքային ստաժ» հասկացությունը, հստակեցվել և ամբողջականացվել է աշխատանքային պայմանագրի բովանդակությունը. փորձաշրջանի պայմանները, ամենամյա արձակուրդի տեսակը և դրա տևողությունը ևս պետք է ամրագրվեն աշխատանքային պայմանագրում:
Սահմանվել է կողմերի էլեկտրոնային ստորագրությամբ աշխատանքային պայմանագիր կնքելու հնարավորությունը, փոխվել և լրացվել են աշխատողի տարիքային կենսաթոշակային տարիքը լրանալու հիմքով աշխատանքային պայմանագրի լուծման կամ այդ հարաբերությունները` որոշակի ժամկետով շարունակելու հիմքերը, համապարփակ կարգավորվել են աշխատանքային պայմանագրի հիմնական պայմանների փոփոխման հետ կապված հարաբերությունները, ամբողջականացվել է աշխատողի հետ վերջնահաշվարկի կատարման կարգը, սահմանվել է ֆիզիկական անձ գործատուի մահվան դեպքում աշխատանքային պայմանագրի լուծման առանձնահատկությունը, սահմանվել է աշխատանքային տարի հասկացությունը, առավել հստակեցվել են գործատուի կողմից կարգապահական տույժ կիրառելու հետ կապված կարգավորումները:
Կիրառական տեսանկյունից առավել պարզեցվել է միջին ժամային աշխատավարձի հաշվարկման կարգը, միջազգային իրավունքի նորմերին և սկզբունքներին համապատասխան` ամբողջական կարգավորման են ենթարկվել մինչև տասնչորս տարեկան երեխաների մասնակցությամբ աշխատանքային հարաբերությունները, վերացվել է մինչև 18 տարեկան աշխատողների նկատմամբ աշխատաժամանակի գումարային հաշվարկ կիրառելու հնարավորությունը, հղի կանանց և մինչև երեք տարեկան երեխա խնամող աշխատողների համար սահմանվել է պարտադիր բժշկական զննության պահանջ` իրենց համաձայնությամբ գիշերային աշխատանքի ներգրավելու դեպքում, աշխատավարձ վճարելիս հաշվարկային թերթիկ ներկայացնելու` գործատուի պարտավորությունը սահմանվել է միայն աշխատողի պահանջով, կատարվել են նաև խմբագրական և հստակեցման բնույթի, տարընթերցումները բացառող այլ փոփոխություններ:
