Լապշինի փաստաբանը պարզաբանումներ է կատարել նրա Իսրայել արտահանձնման վերաբերյալ

Ադրբեջանում դատապարտված բլոգեր Ալեքսանդր Լապշինի փաստաբան Էդուարդ Չեռնինը որոշ պարզաբանումներ է կատարել իր պաշտպանյալի՝ Իսրայել արտահանձնման հարցի վերաբերյալ:

Այս մասին, ինչպես հաղորդում է «Արմենպրես»-ը, հայտնում  է ադրբեջանական «Ինտերֆաքս»-ը:

Փաստաբանի փոխանցմամբ, Լապշինի՝ Իսրայել արտահանձնման հարցը կարող է հստականալ առաջիկա 7-10 օրում:

«Ես մտածում եմ, որ առաջիկա 7-10 օրում հստակ կլինի, թե ինչպիսի քայլեր կձեռնարկվեն այդ ուղղությամբ»,- ասել է Չեռնինը:

Լապշինի փաստաբանը նշել է նաև, որ օգոստոսի 14-ին ուժի մեջ է մտնում Բաքվի դատարանի կողմից Լապշինի նկատմամբ կայացված վճիռը, որի համաձայն` Լապշինին սպասում է 3 տարվա ազատազրկում:

«Այսօր դատարանի վճիռը մտնում է ուժի մեջ: Անհրաժեշտ է հետևել ընթացակարգին: Իսրայելի արդարադատության նախարարությունը պետք է դիմի Ադրբեջանի արդարադատության նախարարությանը, ինչից հետո ադրբեջանական կողմը կքննարկի դա»,- հավելել է նա:

Լապշինի փաստաբանը նշել է նաև, որ իր պաշտպանյալի արտահանձնման գործընթացը չի կարող ինքնաբուխ լինել, և կողմերը պետք է քայլեր ձեռնարկեն այդ ուղղությամբ:

 Հուլիսի 26-ին Լապշինի փաստաբան Էդուարդ Չեռնինը հայտնել էր, որ բլոգերը դիմում է ներկայացրել Իսրայել արտահանձնվելու խնդրանքով: Փաստաբանը նշել է, որ բլոգերը հրաժարվել է բողոքարկել դատարանի որոշումը:

Ծանր հանցագործությունները քննող Բաքվի դատարանում հուլիսի 20-ին հրապարակվել է ՌԴ և Իսրայելի քաղաքացի բլոգեր Ալեքսանդր Լապշինի գործով դատավճիռը:

Լապշինի դեմ դատական գործ էր հարուցվել Ադրբեջանի ՔՕ  281.2 (երկրի դեմ ուղղված հրապարակային կոչեր) և 318 (Ադրբեջանի Հանրապետության պետական սահմանի անօրինական հատում) հոդվածներով: 281.2-րդ հոդվածով Լապշինի մեղադրանքն ապացուցող բավարար փաստեր չեն հայտնաբերվել: Բլոգերը մեղավոր է ճանաչվել միայն պետական սահմանի անօրինական հատման համար. Ադրբեջանում գործող կամայական օրենքով (ՔՕ 318-րդ հոդված) քրեական հետապնդում է սպառնում այն օտարերկրյա քաղաքացիներին, ովքեր Լեռնային Ղարաբաղ են այցելում «առանց պաշտոնական Բաքվի թույլտվության»:

Հուլիսի 19-ին կայացած դատական նիստի ժամանակ Լապշինը, օգտվելով վերջին խոսքի իր իրավունքից, հայտարարել էր, որ չի ընդունում իր դեմ ներկայացված մեղադրանքները:
