ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ ԿԱ ՊԵԿ աշխատակցի ապօրինի գործողությունների փաստով

ՀՀ քաղաքացի Ա. Վ.-ից ստացված հաղորդման հիման վրա ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ ԿԱ ՊԵԿ աշխատակցի ապօրինի գործողությունների փաստով:
Ինչպես «Արմենպրես»-ին տեղեկացրին հատուկ քննչական ծառայությունից, Ա. Վ.-ն հաղորդմամբ հայտնել է, որ համապատասխան ընկերության հետ 14.07.2014թ. կնքված տրանսպորտային միջոցի առուվաճառքի պայմանագրով 67.000 ԱՄՆ դոլարով ձեռք է բերել «Մերսեդես-Բենց» մակնիշի ավտոմեքենա: Միաժամանակ, Ա. Վ.-ն հայտնել է, որ թեև պայմանագիրը կնքել է նշված ընկերության հետ, սակայն տրանսպորտային միջոցի գնման շուրջ բոլոր պայմանավորվածությունները ձեռք է բերել հիշյալ ավտոմեքենայի փաստացի վաճառող ներկայացած, ՀՀ ԿԱ ՊԵԿ աշխատակից Ա. Մ.-ի հետ, ում էլ փոխանցել է ավտոմեքենայի ձեռք բերման գումարը: Հետագայում գնորդ Ա. Վ.-ն պարզել է, որ առուվաճառքի պայմանագրում ավտոմեքենայի արժեքը նշված է ոչ թե 67.000 ԱՄՆ դոլար, այլ դրանից էականորեն քիչ՝ 14.200.000 ՀՀ դրամ, հետևաբար մաքսազերծումն ու հարկային պարտավորությունները նույնպես կատարվել են այդ գումարի հաշվարկմամբ: Պարզել է նաև, որ ավտոմեքենայի վազքը շուրջ 144.000 կիլոմետրով նվազեցված է եղել:
Ա. Վ.-ի հաղորդման համաձայն ` հիշյալ գործողություններով ՊԵԿ աշխատակիցն ապօրինի մասնակցել է տվյալ ընկերության գործունեությանը` հովանավորելով ու արտոնություններ տրամադրելով նրան:
Բացի այդ, Ա. Վ.-ն պարզել է, որ վերը նշված ընկերության կողմից 2012-2014 թվականների ընթացքում ներկրված ավտոմեքենաների առուվաճառքի պայմանագրերում նույնպես նշված են դրանց շուկայական գներից ակնհայտորեն նվազեցված գներ:
Այսպիսով, պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձի կողմից ձեռնարկատիրական գործունեությանն ապօրինի մասնակցելու դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում հարուցվել է քրեական գործ` ՀՀ քրեական օրենսգրքի 310-րդ հոդվածով: Կատարվում է նախաքննություն:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
