 ՀՀ փաստաբանների պալատի և ՀՀ դատական դեպարտամենտի ներկայացուցիչները քննարկել են դատական կարգադրիչների կողմից փաստաբաններին զննության ենթարկելու հետ կապված հարցը: «Արմենպրես»-ի հաղորդմամբ՝քննարկման արդյունքում կողմերը որոշել են համատեղ հայտարարությամբ հանդես գալ, որտեղ կարեւորել են դատարանում դատավարության մասնակիցների և դատարանում գտնվող այլ անձանց կյանքի և առողջության պաշտպանության անհրաժեշտությունը, հատկապես քրեական այն գործերով, որոնցով անձինք մեղադրվում են կյանքի և առողջության դեմ ուղղված, ինչպես նաև հասարակական անվտանգության դեմ ուղղված հանցագործություններ կատարելու մեջ:

 ՀՀ դատական դեպարտամենտը հայտարարում է, որ մինչև հատուկ սարքավորումներ ձեռք բերելը փաստաբանների և նրանց իրերի հետ կապված զննությունը դատական այն գործերով, որոնց ժամանակ անհրաժեշտություն է առաջանալու ապահովել դատավարության մասնակիցների և դատարանում գտնվող այլ անձանց կյանքի և առողջության պաշտպանութունը, որպես կանոն իրականացնելու է հետևյալ կերպ. Եթե մետաղորսիչը ազդանշան է տալիս փաստաբանի կամ նրա մոտ առկա իրերի զննության ժամանակ, ապա փաստաբանին առաջարկվում է հատուկ առանձնացված պահարանում թողնել մետաղական իրերը և կրկին մետաղորսիչով զննվել, եթե կրկին մետաղորսիչը փաստաբանի կամ նրա մոտ առկա իրերի զննության ժամանակ ազդանշան է տալիս, ապա փաստաբանի մոտ առկա իրերի պարունակությունը զննելու դեպքում (եթե փաստաբանը համաձայնվել է անձամբ ցույց տալ պարունակությունը՝ առանց փաստաթղթերի բովանդակությունը բացահայտելու), փաստաբանի պահանջի դեպքում, զննությունը կատարվելու է առանձին սենյակում՝ համապատասխան սեռի դատական կարգադրիչի (փաստաբանի պահանջի դեպքում նաև նրա կողմից այդ պահին հրավիրած ընթերակայի) մասնակցությամբ՝ արդյունքների վերաբերյալ կազմելով արձանագրություն երկու օրինակից (մեկ օրինակը հանձնելով փաստաբանին). դատական կարգադրիչները փաստաբանի պայուսակը կամ այլ իրը զննելու դեպքում՝ ինչպես նախկինում, այնպես էլ հետայսու ինքնուրույն որոնողական գործողություններ չեն կատարելու և որևէ փաստաթղթի բովանդակությանը չեն ծանոթանալու։ Սույն հայտարարությունը չի կարող սահմանափակել կողմերի՝ օրենքով վերապահված իրենց իրավասությունները, այդ թվում՝ ՀՀ փաստաբանների պալատի անդամների անկախությունը:
