: ՀՀ Մարդու իրավունքների պաշտպանին հասցեագրած բողոքով քաղաքացին տեղեկացրել է, որ Դատական ակտերի հարկադիր կատարման ծառայությունը բռնագանձում է տարածել զինվորական հաշմանդամության կենսաթոշակի վրա: Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմից, խնդրի կապակցությամբ պաշտպանի աշխատակազմում սկսվել է բողոքի քննարկման ընթացակարգ: Իրավասու պետական մարմնի հետ կատարված համատեղ աշխատանքների արդյունքում Դատական ակտերի հարկադիր կատարման ծառայության կողմից որոշում է կայացվել քաղաքացու դրամական միջոցների վրա դրված արգելանքը հանելու մասին:

Իրազեկում. «Դատական ակտերի հարկադիր կատարման մասին» ՀՀ օրենքի 60-րդ հոդվածի համաձայն՝ կատարողական թերթով բռնագանձում չի կարող տարածվել այն դրամական գումարների վրա, որոնք վճարվում են`  հաշմանդամներին  ծառայողական պարտականությունները կատարելիս ստացած հաշմության(վիրավորվել, կոնտուզիա, վնասվածք) համար այդ անձանց կամ նրանց մահվան դեպքում` ընտանիքներին  առողջության, ինչպես նաև կերակրողի մահվամբ պատճառված վնասների հատուցման համար: Ալիմենտային պարտավորությունների համար  որպես պետական նպաստ,  վնասակար կամ ծայրահեղ դժվարին պայմաններում աշխատող անձանց` որպես փոխհատուցում,  տուժողին` լրացուցիչ սննդի, առողջարանային բուժման, պրոթեզավորման և նրա  խնամքի համար,  աշխատանքից ազատվելու դեպքում` որպես արձակման նպաստ:
