Գլխավոր դատախազը դիմել է Սահմանադրական դատարան

:Հայաստանի Հանրապետության գլխավոր դատախազը դիմել է ՀՀ սահմանադրական դատարան՝ ՀՀ քրեական դատավարության օրենսգրքի 296-րդ հոդվածի նորմերի՝ ՀՀ Սահմանադրության 61-րդ հոդվածի 1-ին մասին, 63-րդ հոդվածի 1-ին մասին և 103-րդ հոդվածին համապատասխանությունը որոշելու համար: Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից, վիճարկվող նորմերը ներկայումս դատարաններին հնարավարություն են տալիս քրեական գործը մեղադրողին վերադարձնել այն հիմքով, որ մեղադրական եզրակացությունը չի համապատասխանում ՀՀ քրեական դատավարության օրենսգրքով սահմանված պահանջներին: Խոսքն այն պահանջների մասին է, որոնք վերաբերում են քրեական գործով ձեռք բերված ապացույցների մեղադրող կամ արդարացնող բնույթին, վերաբերելիությանը, ապացուցողական արժեքին, որոնք գնահատման ենթակա են ոչ թե քրեական գործը դատական քննության նախապատրաստելու փուլում, այլ դատական ակտ կայացնելիս: Դիմումում նշվել է, որ չնայած վիճարկվող նորմերը դատախազի համար սահմանում են մեղադրական եզրակացության թերությունները շտկելու պարտականություն, սակայն սահմանված չէ վերջինիս կատարման դատավարական կարգ, ավելին, դատախազը մեղադրական եզրակացություն կազմելու, ուստի և վերակազմելու լիազորություն չունի, ինչի արդյունքում հնարավոր չի լինում ապահովել մեղադրական եզրակացության թերությունները շտկելու դատարանի պահանջի կատարումը: Բացի այդ, վիճարկվող դրույթները հնարավորություն չեն տալիս բողոքարկել քրեական գործը մեղադրողին վերադարձնելու մասին դատարանի անհիմն և անօրինական, ուստի և կատարման ոչ ենթակա որոշումը: Դա հանգեցնում է դատական քննության նախապատրաստելու փուլում քրեական գործով վարույթի արգելափակման: Վերոգրյալի հիման վրա ՀՀ գլխավոր դատախազը փաստարկել է, որ ՀՀ քրեական դատավարության օրենսգրքի 296-րդ հոդվածի ներկայիս նորմերը չեն ապահովում արդար դատաքննության հիմնարար իրավունքի՝ դատարանի անկողմնակալության, մատչելիության և ողջամիտ ժամկետի իրացումը, դատավարության մասնակիցների իրավունքների պաշտպանության արդյունավետ միջոցի իրավունքը և խոչընդոտում են ՀՀ դատախազության՝ մեղադրանքի պաշտպանության սահմանադրական լիազորության իրականացմանը:
