Բողոքի հիմքերը դատախազն անտեսեց .Վճռաբեկը Սաֆարյանի բողոքի քննությունը հետաձգեց

ՀՀ վճռաբեկ դատարանում քննվում է ընդդիմադիր ակտիվիստ Գևորգ Սաֆարյանի բողոքն ընդդեմ ՀՀ վերաքննիչ դատարանի վճռի: Նշենք, որ Վերաքննիչ դատարանը մեկ ամիս առաջ մերժել էր տոնածառի գործով բողոքը` ուժի մեջ թողնելով առաջին ատյանի երկու տարվա ազատազրկման վճիռը:
Դատական նիստին Գևորգ Սաֆարյանի շահերի պաշտպան Տիգրան Հայրապետյանը միջնորդություն ներկայացրեց, որպեսզի ոստիկանների թիվը դահլիճում նվազեցվի և ոստիկանների ու իրենց միջև պատշաճ հեռավորություն պահպանվի։
«Դատական օրենսգրքում նշված է, որ դատարանում դատարանի կարգուկանոնը պետք է պահպանեն բացարձակապես կարգադրիչները, ես ուղղակի խնդրում եմ, որ ոստիկանների այսքան շատ ներկայացվածությունը դատական նիստերում արգելել, խնդրում եմ, որպեսզի դատական կարգադրիչները կարգուկանոն պահպանեն», - ասաց փաստաբան Տիգրան Հայրապետյանը։
Դատախազն առարկեց միջնորդությունը, ասելով, որ այն անհիմն է:
Դատավորն էլ միջնորդությունը մերժեց, ասելով, որ ոստիկանների ներկայությունը պայմանավորված է միայն ամբաստանյալին հսկելով, իսկ դատական նիստերի դահլիճում կարգուկանոնը վերահսկում են բացառապես դատական կարգադրիչները:
Այնուհետև դատավորը մեկ այլ նիստի մասնակցելու պատճառաբանությամբ հետաձգեց դատական նիստը: Հաջորդ նիստը նշանակվեց օգոստոսի 17-ին:
Նիստի հետաձգումից հետո Տիգրան Հայրապետյանը Tert.am-ի հետ զրույցում ասաց, որ դատական նիստի ընթացքում մեղադրող դատախազը մոտ մեկ ժամ խոսեց, սակայն դատախազը չանդրադարձավ հարցին` ոստիկանների բռնություններն օրինաչափ են եղել, թե ոչ.«Բողոքի հիմքերը դատախազն անտեսեց»:
Հիշեցնենք, որ Գևորգ Սաֆարյանը կալանքի տակ է 2016թ-ի հունվարի մեկից: Մեկ տարի առաջ Գևորգ Սաֆարյանը Ազատության հրապարակում Նոր տարվա գիշերը փորձել էր տոնածառ տեղադրել, նշել Ամանորը, սակայն ոստիկանները թույլ չէին տվել: Նրան մեղադրում են այդ գիշեր ոստիկանների նկատմամբ ոչ վտանգավոր բռնություն գործադրելու համար, որի մեջ դատարանը մեղավոր էր ճանաչել նրան և դատապարտել երկու տարի ազատազրկման:
