Հիփոթեքային վարկի սպասարկման տոկոսները կփոխհատուցվեն եկամտահարկով

Կառավարության՝ հուլիսի 27–ին կայանալիք նիստի օրակարգ ներառված նախագծով սահմանվել է հիփոթեքային վարկի սպասարկման համար վճարված տոկոսների գումարների չափով ֆիզիկական անձանց կողմից վճարված եկամտային հարկի գումարների փոխհատուցման կարգը:
 
Նախագծով սահմանվում է, որ հիփոթեքային վարկի սպասարկման համար վճարվող կամ վճարված տոկոսների գումարների չափով վարձու աշխատողի, անհատ ձեռնարկատիրոջ և նոտարի կողմից 2015, 2016 և 2017 թթ. հաշվետու եռամսյակների համար վճարված եկամտային հարկի գումարները վերադարձվում են: Այս որոշումն ուժի մեջ է մտնում 2018 թ. հունվարի 1–ից:
 
Սրանից բացի՝ տվյալ վարկառուի կողմից հաշվետու եռամսյակի ընթացքում վճարված տոկոսների մասին ԱՔՌԱ վարկային բյուրոյի կողմից կառավարությանն առընթեր պետական եկամուտների կոմիտե ներկայացվող տեղեկատվության հիման վրա հիփոթեքային վարկի սպասարկման համար վճարված տոկոսների գումարների չափով ֆիզիկական անձանց կողմից վճարված եկամտային հարկի գումարների փոխհատուցման դրույթը ուժի մեջ է մտնում 2019 թ. հուլիսի 1–ից:
 
Նախագծով կարգավորվում են Հարկային օրենսգրքի 160–րդ հոդվածի համաձայն ՀՀ ռեզիդենտ ֆինանսական կազմակերպությունից 2018 թ. հունվարի 1–ից հետո ստացված և փաստացի բնակարանի ձեռքբերմանը կամ անհատական բնակելի տան կառուցմանն ուղղված հիփոթեքային վարկի սպասարկման համար վճարվող տոկոսների գումարների չափով ֆիզիկական անձանց՝ բացառությամբ վարձու աշխատող չհամարվող անհատ ձեռնարկատիրոջ ու նոտարի, օրենքով սահմանված կարգով վճարված (այդ թվում` հարկային գործակալի միջոցով գանձված) եկամտային հարկը փոխհատուցելու հետ կապված հարաբերությունները:
 
Նախագծի նպատակը Հարկային օրենսգրքի կիրարկումն ապահովելն է: Նախագիծն իր հերթին մշակվել է Ֆինանսների նախարարության կողմից:
 
Ինչպես կարդում ենք նախագծում՝ խնդիրը կայանում է նրանում, որ 2018 թ. հունվարի 1–ից ուժի մեջ է մտնելու Հարկային օրենսգիրքը, որով ուժը կորցրած է ճանաչվելու «Եկամտային հարկի մասին» օրենքը և համապատասխանաբար եկամտային հարկի վերադարձի գործընթացը կարգավորող գործող կարգը: Այս առումով, ՀՀ հարկային օրենսգրքի ուժի մեջ մտնելուց հետո ստացվելու է այնպես, որ հիփոթեքային վարկի սպասարկման համար վճարված տոկոսները եկամտային հարկի գումարներից փոխհատուցելու գործընթացը կարգավորված չէ:
 
Նախագծով առաջարկվում է սահմանել Հարկային օրենսգիրքը ուժի մեջ մտնելուց հետո հիփոթեքային վարկի սպասարկման համար վճարված տոկոսների գումարների չափով վճարված եկամտային հարկի գումարները պետական բյուջեից փոխհատուցելու կարգը: Նախագծի կարգավորման առարկան հիփոթեքային վարկի սպասարկման համար վճարված տոկոսների գումարների չափով վճարված եկամտային հարկի գումարները պետական բյուջեից փոխհատուցելու կարգն է: Նախագծի ընդունման արդյունքում ակնկալվում է կարգավորել 2018 թ. հունվարի 1–ից հետո հիփոթեքային վարկի սպասարկման համար վճարված տոկոսների գումարները եկամտային հարկի գումարներից փոխհատուցելու գործընթացը իրականացնելու հետ կապված հարաբերությունները:
