2017թ. հուլիսի 20-ին Մարդու իրավունքների եվրոպական դատարանը փաստաբաններ Ռուբեն Սահակյանի, Լուսինե Սահակյանի եւ Երվանդ Վարոսյանի կողմից ներկայացված բողոքի հիման վրա ճանաչել է ՀՀ քաղաքացի Արմեն Բադալյանի՝ ՄԻԵԿ 5-րդ հոդվածով նախատեսված իրավունքի խախտումը (ազատության ու անձնական անձեռնմխելիության իրավունք), և Հայաստանի կառավարությանը պարտավորեցրել է Ա. Բադալյանին որպես փոխհատուցում վճարել 3000 եվրո: Այս մասին NEWS.am-ի հետ զրույցում ասաց փաստաբան Լուսինե Սահակյանը։

«2011թ. ամռանը Արմեն Բադալյանի հաղորդման հիման վրա ՀՀ ոստիկանության ՔԳՎ Արմավիրի մարզի քննչական բաժնի Մեծամորի քննչական բաժնի քննիչ, ոստիկանության ավագ լեյտենանտ Արմեն Ումուրշատյանի կողմից նյութեր են նախապատրաստվել: 22.07.2011թ. Ա.Բադալյանի և քննիչի միջև հեռախոսային խոսակցություններ են տեղի ունեցել, որոնց ընթացքում Ա.Բադալյանը քննիչի կողմից իր նախկին կնոջ հասցեին արված արտահայտությունից զայրացած հայհոյանքներ էր տվել քննիչին: Քանի որ Ա.Բադալյանի գործողությունները քրեորեն պատժելի չէին, իսկ քննիչի կողմից ձայնագրված խոսակցության ընթացքում էլ լսվում էին միայն վիրավորանքներ, քննչական բաժանմունքի 2 քննիչ ցուցմունք տվեցին, թե բարձրախոսով լսել են խոսակցության չձայնագրված հատվածը, և իբր Ա.Բադալյանը նաև սպառնալիքներ է հնչեցրել քննիչ Ա.Ումուրշատյանի հասցեին:

Նույն օրը նույն մարզի քննչական բաժնում հարուցվել էր քրեական գործ ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասի հատկանիշներով (իշխանության ներկայացուցչի նկատմամբ բռնություն գործադրելու սպառնալիքը կապված նրա կողմից ծառայողական պարտականությունները կատարելու հետ): 23.07.2012թ. Արմեն Բադալյանը ձերբակալվել էր: 25.07.2012թ. նրան մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասով, նույն օրը նրա նկատմամբ ՀՀ Արմավիրի մարզի ընդհանուր իրավասության դատարանի կողմից որպես խափանման միջոց է ընտրվել կալանավորումը: Հենց այս՝ անձին կալանավորելու մասին դատարանի կողմից կայացված որոշման հիման վրա Ա.Բադալյանին անազատության մեջ պահելն է եվրոպական դատարանը համարել Եվրոպական Կոնվենցիայի խախտում»,- մանրամասնեց փաստաբանը:

Լուսինե Սահակյանի խոսքով՝ նույն գործով եվրոպական դատարանում քննվում է մեկ այլ գանգատ ևս, որը վերաբերում է Ա.Բադալյանի՝ կոնվենցիայով նախատեսված այլ իրավունքների խախտմանը:

«Այս գործը հետաքրքրական է նրանով, որ քննության ընթացքում որպես Արմեն Բադալյանի պաշտպան ներգրավվեց այն ժամանակ Փաստաբանների պալատի նախագահ Ռուբեն Սահակյանը, ում գործի մանրամասները մի քանի անգամ ներկայացրել էր Ա.Բադալյանի պաշտպանությունն իրականացնող հանրային պաշտպանն ու պատմել, որ մեղադրյալի նկատմամբ ակնհայտ կողմնակալ վերաբերմունք է դրսևորվում, քանի որ գործով «տուժողը» հանդիսանում էր քննիչը: Փաստորեն ոստիկանության քննիչի վիրավորված ինքնասիրությունը ապօրինությունների գնով վերականգնելու դիմաց այսօր վճարելու է Հայաստանի Հանրապետությունը, այսինքն մենք բոլորս»,- ասաց փաստաբանը:
