ՓՊ խորհուրդը փաստաբաններին զննության ենթարկելու դեպքերի վերաբերյալ որոշում է կայացրել

: ՀՀ փաստաբանների պալատի խորհուրդը  փաստաբաններին զննության ենթարկելու դեպքերի վերաբերյալ որոշում է կայացրել: Ինչպես «Արմենպրես»-ին  տեղեկացրին ՀՀ Փաստաբանների պալատի մամուլի ծառայությունից, ՓՊ խորհուրդը փաստաբաններին զննության ենթարկելու դեպքերի վերաբերյալ հայտարարում է.

«Փաստաբանները քրեական գործերով արդարադատության իրականացման հարցում կարևոր և անփոխարինելի սուբյեկտներ են և պետական ծառայողները պարտավոր են փաստաբանների նկատմամբ ցուցաբերել հարգալից վերաբերմունք՝ղեկավարվելով փաստաբանի բարեխղճության կանխավարկածով:  Առանց հատուկ սարքերի փաստաբանին զննելու համար դատական կարգադրիչը պետք է ունենա իրավական և փաստական հիմքեր: Փաստական հիմքը կարող է լինել այն դեպքում, երբ կա ողջամիտ կասկած, որ փաստաբանը կարող է օրենքով արգելված իրեր տեղափոխել: Անթույլատրելի է զննություն կատարելիս դրսևորել խտրական վերաբերմունք փաստաբանների նկատմամբ: Զննությունը չի կարող փաստացի վերածվել խուզարկության կամ ստեղծել փաստաբանական գաղտնիքի հրապարակման վտանգ կամ փաստաբանի համար նվաստացուցիչ պայմաններ: Անթույլատրելի է դատարանի և դատական կարգադրիչների կողմից՝ փաստաբանի մասնագիտական գործունեության իրականացման համար անհրաժեշտ իրերը, այդ թվում՝ անվտանգ տարայով խմելու ջուրը, տեղափոխելու արգելքը»:

Փաստաբանների պալատի խորհուրդը առաջարկել է ՀՀ դատական դեպարտամենտին զննությունը կատարել տեխնիկական միջոցներով (սկանավորմամբ)՝ առանց փաստաբաններին լրացուցիչ անհարմարություն պատճառելու:
«Փաստական հիմքի առկայությամբ փաստաբանի պայուսակի պարունակությունը զննելու դեպքում (եթե փաստաբանը համաձայնել է անձամբ ցույց տալ պարունակությունը՝ առանց փաստաթղթերի բովանդակությունը բացահայտելու), փաստաբանի պահանջի դեպքում, զննությունը կատարել առանձին սենյակում՝ համապատասխան սեռի դատական ծառայողների և ընթերակաների մասնակցությամբ՝ արդյունքների վերաբերյալ կազմելով արձանագրություն երկու օրինակից (մեկ օրինակը հանձնելով փաստաբանին): Դատական կարգադրիչներին հրահանգել, որ փաստաբանի պայուսակը կամ այլ իրը զննելու դեպքում, դատական կարգադրիչն իրավասու չէ՝ ա) ինքնուրույն որոնողական գործողություններ կատարել, այդ թվում՝ բացել պայուսակը կամ տեղաշարժել պայուսակի մեջ գտնվող իրերը, և բ) որևէ փաստաթղթի բովանդակությանը ծանոթանալ»:
