Շենգավիթ վարչական շրջանում գտնվող «Լիա» գեղեցկության սրահում մեկ տարի առաջ տեղի ունեցած սպանության գործով ամբաստանյալ Ալիկ Բանդուրյանը (Նորատուսցի Ալիկ) չի ընդունում իրեն առաջադրված մեղադրանքը: Այսօր՝ հուլիսի 20-ին, լրագրողների հետ զրույցում նրա շահերի պաշտպան Երեմ Սարգսյանը նշեց, որ  քրեական գործում իր պաշտպանյալի մեղադրանքը հիմնավորող բավարար ապացույցներ չկան:

«Դատաքննության ընթացքում կհամոզվեք, որ այդ մեղադրանքն ուղղակի աբսուրդ է, եւ այդ մեղադրանքը հիմնավորող ապացույցներ քրեական գործում չկան: Սա երեւի թե մշտական պրոցեսն է, որ հնչեղություն ունեցող գործերով ծանր մեղադրանքներին հնարավորինս ծանր որակումներ պետք է տրվեն: Օրենքն ասում է՝ մեղադրանքն ապացուցող բավարար հիմքեր, որպիսիք այս գործով չկան»,- նշեց նա:

Նրա խոսքով, քրեական գործում եթե ինչ-որ գաղտնալսում կա՝ գործի համար ապացույց չի կարող հանդիսանալ եւ չի կարող դրվել մեղադրանքի հիմքում:

 «Քրեական գործում գաղտնալսումներ առկա են, դրան կանդրադառնանք դատաքննության ընթացքում: Սակայն, եթե ինչ-որ գաղտնալսում կա, դա գործի համար ապացույց չի կարող հանդիսանալ եւ ընդհանրապես չի կարող դրվել մեղադրանքի հիմքում»:

Նշենք, որ գաղտնալսումները վերաբերում են Նորատուսցի Ալիկի եւ Չարբախցի Գեղամի հեռախոսային խոսակցություններին: Ըստ այդ խոսակցությունների՝ Ալիկը խոսելով սպանված Մուշեղ Մուշեղյանի մասին ասել է՝ դրան մորթեք, սատկացրեք, մահակներով ոտքերը ջարդեք:

Հիշեցնենք՝ 2016 թվականի նոյեմբերի 13-ին Երևանի Շենգավիթ վարչական շրջանում գործող «Լիա» գեղեցկության սրահում արձակված կրակոցների հետևանքով երկու անձ՝ Երևանի բնակիչներ Գ. Ավետիսյանը և Մ. Մուշեղյանը, ստացել են կյանքի հետ անհամատեղելի մարմնական վնասվածքներ և մահացել: Մուշեղյանի դիակի զննությամբ հայտնաբերվել էր նաև կտրող-ծակող առարկայով պատճառված մարմնական վնասվածք՝ որովայնի շրջանում։

Քրեական գործով ձեռնարկված մեծածավալ քննչական և օպերատիվ-որոնողական միջոցառումների արդյունքում պարզվել է միջադեպի շարժառիթը, անմիջական մասնակցություն ունեցած անձանց շրջանակը, անհատականացվել նրանց գործողությունները:

Մինչդատական վարույթում ձեռք բերված ապացույցների համակցությամբ՝ Պ. Իսրայելյանին մեղադրանք է առաջադրվել Քրեական օրենսգրքի 104-րդ հոդվածի 2-րդ մասի 7-րդ կետով, Ա. Բանդուրյանին (մականունը՝ «Քյավառցի Ալիկ»)՝ Քրեական օրենսգրքի 38-112-րդ հոդվածի 2-րդ մասի 6-րդ կետով, Ա. Գասպարյանին (մականունը՝ «Բդո»)՝ Քրեական օրենսգրքի 335-րդ հոդվածի 1-ին մասով:
