ՀՀ ՀՔԾ-ն քրգործ է հարուցել պաշտոնական կեղծ փաստաթուղթ իրացնելու և պաշտոնեական դիրքը չարաշահելու փաստերով

 ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձանց՝ ՀՀ արդարադատության նախարարության դատական ակտերի հարկադիր կատարման հա ծառայության ծառայողների, ինչպես նաև ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեի աշխատողների կողմից թույլ տրված չարաշահումների վերաբերյալ Է. Կ.-ի հաղորդման հիման վրա: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՔԾ լրատվական ծառայությունից՝ հավելելով. «Այսպես, Է. Կ.-ն ՀՀ հատուկ քննչական ծառայությունում հաղորդում է տվել, որ իր հայցադիմումների առթիվ դատարանում քննված գործերով տրված կատարողական թերթերի հիման վրա որոշում է կայացվել արգելանք կիրառել Երևան քաղաքի Կուրղինյան փողոցի 1-ին շենքի թիվ 45 հասցեի բնակարանի նկատմամբ: Սակայն ՀՀ ԱՆ ԴԱՀԿ ծառայության Շենգավիթի բաժնի ծառայողները հարուցված կատարողական վարույթով պատշաճ գործողություններ չեն կատարել:

Բացի այդ, ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեի աշխատակիցները 2013 թվականի օգոստոսի 30-ին արգելադրված բնակարանի սեփականատերերին տեղեկանք են տվել այն մասին, որ հիշյալ անշարժ գույքի նկատմամբ գրանցված սահմանափակումներ չկան, այն դեպքում, երբ ՀՀ ԱՆ ԴԱՀԿ ծառայությունից ստացված գրության համաձայն՝ նշված բնակարանի նկատմամբ 2011 թվականի սեպտեմբերի 5-ին կիրառված արգելանքը երբևէ չի վերացվել:

Է. Կ.-ն հայտնել է նաև, որ ՀՀ ԱՆ ԴԱՀԿ ծառայության ծառայողների անգործության և ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեի աշխատակիցների կողմից տրված պաշտոնական կեղծ փաստաթղթի օգտագործմամբ բնակարանատերերը հիշյալ անշարժ գույքը վաճառել են մեկ այլ քաղաքացու՝ այդ կերպ խոչընդոտելով օրինական ուժի մեջ մտած դատական ակտերի կատարմանը:

Այսպիսով, իրավունք վերապահող պաշտոնական կեղծ փաստաթուղթ իրացնելու, ինչպես նաև պաշտոնատար անձի կողմից պաշտոնեական լիազորությունների չարաշահման վերը նշված դեպքերի առթիվ ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ քրեական օրենսգրքի 308-րդ և 325-րդ հոդվածների 1-ին մասերով:

Կատարվում է նախաքննություն:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեականդատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով»:
