Շրջանառության են ներկայացվել Հայաստանում զինծառայողների իրավունքները երաշխավորող օրենսդրական նախագծեր

ՀՀ մարդու իրավունքների պաշտպանի աշխատակազմում զինծառայողների իրավունքների վերաբերյալ բողոքների ուսումնասիրության հիման վրա մշակվել և շրջանառության է ներկայացվել օրենսդրական նախագծերի փաթեթ: Նախագծերը, մասնավորապես, վերաբերում են զինվորական ծառայության ոլորտում զինծառայողների իրավունքների երաշխավորմանը: Այս մասին «Արմենպրես»-ին տեղեկացրին Մարդու իրավունքների պաշտպանի աշխատակազմից: 

Փաթեթում տեղ են գտել հետևյալ հիմնական առաջարկները. 

  • նախկինում հանցագործություն կատարած լինելու փաստը, որպես  զինծառայողի կարգապահական պատասխանատվությունը ծանրացնող հանգամանք, բացառել,
  • հստակ ամրագրելկարգապահական տույժի մասին հրամանը զինծառայողին տրամադրելու կամ հայտարարելու պարտադիր պահանջ: Սահմանել այն որոշումների տեսակները, որոնք կարող են ընդունվել վերադաս հրամանատարի կողմից՝ կարգապահական տույժ տալու մասին որոշումը զինծառայողի կողմից բողոքարկելու արդյունքում,
  • բացառել զինծառայողի նկատմամբ «օրվա արտահերթ վերակարգի» կիրառումը՝ որպես կարգապահական տույժ,
  • օրենսդրությամբ ուղղակիորեն ամրագրել, որ ծառայողական քննությանը մասնակցելու պահից զինծառայողն իրավունք ունի գրավոր ծանոթանալու իր իրավունքներին և պարտականություններին,
  • հստակեցնել զինծառայողների նկատմամբ ծառայողական քննությունը դադարեցնելու, կասեցնելու, քննությունը վերսկսելու հիմքերը և ընթացակարգը,
  • բացառել վարժական հավաքներից խուսափելու համար միաժամանակ և՛ քրեական, և՛ վարչական պատասխանատվության ենթարկելը,
  • հստակ սահմանել զինապարտների և զինծառայողների առողջական վիճակի բժշկական ու ռազմաբժշկական փորձաքննություն իրականացնող մարմինների որոշումներին (եզրակացություններին) վերաբերող  պահանջները և դրանցում պարտադիր ներառվող տեղեկությունների շրջանակը,
  • օրենսդրությամբ ամրագրել այն դեպքերը, երբ պարտադիր զինվորական ծառայության անցնող նորակոչիկը, իր ցանկությամբ, կարող է զորակոչվել պարտադիր ժամկետային զինվորական ծառայության մեջ գտնվող եղբոր զորամաս:

Վերոնշյալ նախագծերը ներկայացվել են համապատասխան պետական մարմիններ և իրավապաշտպան կազմակերպություններ՝ կարծիքի:
