 Մարդու իրավունքների եվրոպական դատարանում թուրք ազգայնական գործիչ Դողու Փերինչեքի գործով «Փերինչեքն ընդդեմ Շվեյացրիայի» դատական գործում Հայաստանը որպես երրորդ կողմ ներկայացնող Ջեֆրի Ռոբերտսոնը և Ամալ քլունին հայտարարություն են տարածել ՄԻԵԴ վճռի վերաբերյալ:: Ստորև «Արմենպրես»-ը մեջբերում է հայտարարության տեքստն ամբողջությամբ:

«Մենք գոհ ենք, որ Մարդու իրավունքների եվրոպական դատարանն այսօր հավանության արժանացրեց Դողու Փերինչեքի և Շվեյցարիայի միջև գործին որպես երրորդ կողմ ներգրավված Հայաստանի կառավարության օգտին բերված մեր փաստարկը: Այդ վճիռը Հայաստանի համար հաղթանակ է:

Այսօր Եվրոպական դատարանն արձանագրեց, որ խոսքի ազատությունը ենթակա չէ սահմանափակման, եթե այն չի սերմանում բռնություն կամ ռասայական ատելություն: Փաստորեն, շվեյցարական իշխանությունները չպետք է հետապնդեին Փերինչեքին, քանի որ թուրքերենով արված նրա դատարկախոս հայտարարությունը բացարձակապես չէր կարող որևէ ազդեցություն ունենալ Շվեյցարիայում սոցիալական ներդաշնակության և ռասաների միջև հարաբերությունների վրա:

Հայաստանը գործին ներգրավվել է միայն մեկ նպատակով. ստորին պալատը կասկածի տակ էր դրել 1915 թվականին հայերի նկատմամբ իրականացրած ցեղասպանության փաստը: Որպես փաստաբաններ՝ մենք ձգտել ենք ուղղել այս կոպիտ սխալը, և Մեծ պալատն այդպես էլ վարվեց: Այսօրվա վճիռը չի վիճարկում Հայոց ցեղասպանության փաստը. տասը դատավոր նշեց, որ ընդհանրապես այդ հարցը չպետք է քննարկվի, մինչդեռ դատավորներից յոթն արձանագրել են, որ «Հայոց ցեղասպանությունը հստակորեն ամրագրված պատմական փաստ է»:

Վճիռը նաև վերահաստատում է հայերի՝ Եվրոպական իրավունքով պահպանվող իրենց արժանապատվության նկատմամբ հարգանքի և պաշտպանության իրավունքը, այդ թվում՝ այն շրջանակներում, որն առնչվում է օսմանյան թուրքերի կողմից հայերի ռասայի շուրջ կեսի ոչնչացման հետևանքով վնաս կրած հայկական համայնքի ինքնությանը (պարբերություն 227):

Արտահայտվելու ազատության կարևորությունը վերահաստատող Դատարանի այս վճիռը կարևոր հետևանքներ կունենա նաև Թուրքիայի համար, որը Եվրոպական դատարանում ներկայացված պետությունների շրջանում խոսքի ազատության ամենավատ ցուցանիշներն ունի: Թուրքիան այլևս չի կարող արդարացնել Հրանտ Դինքի նմաններին քրեական հետապնդման ենթարկելը. անձինք, ովքեր գրելով Հայոց ցեղասպանության իրականության մասին՝ Քրեական օրենսգրքի 301-րդ հոդվածի հիմքով մեղադրվում են «թուրքական ինքնությունը վիրավորելու» մեջ: Փերինչեքի գործով արված մեկնաբանությունների համաձայնÕ այս հետապնդումներն ամբողջությամբ հակասում են Մարդու իրավունքների եվրոպական կոնվենցիայի 10-րդ հոդվածով ամրագրված խոսքի ազատության երաշխիքներին: Մենք կոչ ենք անում  Թուրքիային վերացնել հոդված 301-ը և դադարեցնել դրանով պայմանավորված չարամիտ հետապնդումները:

Փերինչեքը սադրիչ է, ում չպետք է դարձնեին նահատակ, ինչին նա այդքան ձգտում էր: Անհրաժեշտ է նշել, որ Դատարանը մերժել է նրա՝ 120,000 եվրոյի փոխհատուցման պահանջը և ոչինչ չի հատուցել՝ նույնիսկ նրա սեփական իրավաբանական ծախսերը»:
