Ավարտվել է ժամկետային զինծառայողի սպանության դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը

ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության երկրորդ կայազորային քննչական բաժնում ավարտվել է ժամկետային զինծառայող Վահագն Գագիկի Վիրաբյանի սպանության դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը։ Քրեական գործով պարզվել է ենթադրյալ հանցագործություն կատարած անձի ինքնությունը, շարժառիթը։ Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից:
Ժամկետային զինծառայող Վ.Վիրաբյանը կյանքի հետ անհամատեղելի հրազենային մարմնական վնասվածքներն ստացել է 15.10.2016թ.՝ ժամը 08:40-ի սահմաններում, N զորամասի պահպանության տեղամասի մարտական դիրքում հերթապահություն իրականացնելիս։
Նախնական քննությամբ պարզվել է, որ զինծառայողի ուղղությամբ կրակահերթ է արձակել նույն զորամասի մեկ այլ զինծառայող, ով ընդգրկված է եղել նույն հերթափոխում։ Ձեռք բերված փաստական տվյալների համաձայն՝ զինծառայողների միջև վիճաբանություն է առաջացել՝ մարտական ծառայության ընթացքում քնելու և այդ մասին վերադասին տեղեկացնելու համար, որի ժամանակ ծառայակիցը կրակահերթ է արձակել Վ.Վիրաբյանի ուղղությամբ իրեն ամրակցված ինքնաձիգից՝ դեմքի և կրծքավանդակի շրջանում պատճառելով կյանքի հետ անհամատեղելի հրազենային վնասվածքներ։
Բացի այդ, քրեական գործով ձեռնարկված մեծածավալ քննչական գործողությունների արդյունքում բացահայտվել են ՀՀ քրեական օրենսգրքով նախատեսված հանցագործության այլ դեպքեր ևս։
Մինչդատական վարույթում ձեռք բերված ապացույցների համակցությամբ մեղադրանք է առաջադրվել երկու ժամկետային զինծառայողի. նռնակաձիգի օգնականին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 1-ին մասի և 38-363 հոդվածի 3-րդ մասի հատկանիշներով և նրա նրա նկատմամբ որպես խափանման միջոց է կիրառվել կալանավորումը, իսկ նույն ջոկի ավագ հրաձիգին՝ ՀՀ քրեական օրենսգրքի 361-րդ հոդվածի 1-ին մասի և 363-րդ հոդվածի 3-րդ մասի հատկանիշներով։ Վերջինիս նկատմամբ որպես խափանման միջոց է ընտրվել զորամասի հրամանատարության հսկողությանը հանձնելը:
Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
