 Սահմանադրական իրավունքի մասնագետը միջազգային իրավունքների ճգնաժամի հիմնարար պատճառներից մեկը համարում է  միջազգային հարաբերություններում սահմանադրականության սկզբունքների բացակայությունը: «Արմենպրես»-ի հաղորդմամբ՝ հուլիսի 5-ին լրագրողների հետ հանդիպման ժամանակ սահմանադրական իրավունքի մասնագետ Վարդան Այվազյանը զարմանալի չհամարեց այն հանգամանքը, որ կոնստիտուցիոնալիզմը միջազգային իրավունքի հիմնաքարն է:

«Որքան միջազգային հանրությունը շեղվում է սահմանադրականության սկզբունքներից, տեսնում ենք ներկայիս միջազգային հարաբերությունների անմխիթար վիճակը, ինչը թույլ է տալիս տարբեր երկրների ղեկավարներին, որ միջազգային հարաբերությունները ծառայեցնեն իրենց քմահաճույքներին»,-ասաց Այվազյանը՝ հավելելով, որ այդ առումով մեր երկրի առջև մեծ մարտահրավեր է կանգնած, որպեսզի մեր սահմանադրականության ամրապնդման միջոցով կարողանանք ամրացնել  պետականությունը, ինչպես նաև մասնակից լինել համաշխարհային գլոբալ գործընթացներին: Վերջիններս տեղի են ունենում աննախադեպ արագ, սակայն որևէ իրավական հիմք միջազգային հանրությունը չի մշակում, որպեսզի այն ընթանա կարգավորված և հավասարակշռված:

Նրա խոսքով՝ թեպետ ՀՀ սահմանադրությունն անցած երկու փոփոխություններն իրենց առաքելությունը կատարել էին, այդուհանդերձ արդեն մեկ ու կես տարի է ապրում ենք անցում կատարելով նոր կառավարման ձևի՝ խորհրդարանական կառավարման համակարգի: Այվազյանի դիտարկմամբ՝ բոլորը հույսեր են կապում, որ նոր ընդունված Սահմանադրությունը կարող է առաջընթացի նախադրյալներ ստեղծել:

«Բոլոր ժողովրդավար ուղղություն բռնած պետությունների սահմանադրություններն առաջարկում են պետության և մարդու կատարյալ մոդել, ընդամենը ժողովուրդը և իշխանությունները պետք է միավորվեն և ձգտեն այդ մոդելին: Այսինքն՝ եթե մեր զարգացման նախադրյալները կապենք միայն նրա հետ, որ ունենք նոր սահմանադրություն և ոչինչ չանենք, ապա չենք հասնի ոչ մի բանի: Գտնվելով քաղաքակրթությունների իրավական համակարգերի խաչմերուկում, անթույլատրելի էր, որ մենք դրանք բոլորը համատեղեինք: Մեր սահմանադրությունը թույլ է տվել, որ մենք այն կազմենք բնական իրավունքի հիմքով: Այսինքն՝ մարդ, պետություն, կրոն, ժողովուրդ, և այլ դրսևորումները մեր փոփոխված սահմանադրությունը դիտարկել է բնական օրինաչափությունների տիրույթում, և սա շատ մեծ հնարավորություն է զարգացման համար»,-ընդգծեց սահմանադրական իրավունքի մասնագետը:
