Ժիրայր Սեֆիլյանի և մյուսների գործով դատական նիստին նոր մեղադրող կողմ է ներգրավվել

Շենգավիթ վարչական շրջանի ընդհանուր իրավասության դատարանում դատավոր Տաթևիկ Գրիգորյանի նախագահությամբ հուլիսի 4-ին տեղի ունեցավ Ժիրայր Սեֆիլյանի և մյուսների գործով դատական նիստը: «Արմենպրես»-ի հաղորդմամբ` մեղադրող դատախազ Պետրոս Պետրոսյանը տեղեկացրեց, որ որպես մեղադրող կողմ է ներգրավվել նաև ՀՀ գլխավոր դատախազության թմրանյութերի ապօրինի շրջանառության հետ կապված և կիբեռհանցագործությունների գործերով վարչության պետի տեղակալ Հակոբ Ենոքյանը:

Դատավորը պաշտպանության կողմին հարց ուղղեց Հակոբ Ենոքյանին բացարկ հայտնելու առնչությամբ: Պաշտպան Արայիկ Պապիկյանը նշեց, որ մինչ այդ հարցին անրադառնալը նախ պետք է ստուգվի ամբաստանյալների ինքնությունը, ինչին դատավոր Տաթևիկ Գրիգորյանըպարզաբանեց, որ նախորդ դատական նիստում ամբաստանյալների ինքնությունը պատշաճ կերպով ստուգվել է:  

Պաշտպան Արայիկ Պապիկյանը ասաց, որ նոր մեղադրողի վերաբերյալ կարող է կարծիք կազմել միայն պաշպանյալի հետ խորհրդակցելուց հետո, ինչի հնարավորությունը դատարանը չի տալիս:

«Դատարանը հնարավորություն տվել է ամբաստանյալներին մասնակցելու դատական քննությանը, կարծիք հայտնելու, դատախազին բացարկ հայտնելու, նախագահող դատավորին ինքնաբացարկ հայտնելու իրենց իրավունքները, սակայն ամբաստանյալները  իրենց  գործողություններով զրկել են դատական քննությանը մասնակցելու հնարավորությունից: Ավելին, պաշտպանյալներին հնարավորություն է տվել պաշտպանների հետ տեսակցելու և իրենց դիրքորոշումը քննարկելու համար»,- ընդգծեց Գրիգորյանը:

Փաստաբան Նինա Կարապետյանցը փորձեց ելույթ ունենալ, սակայն դատարանը նրան այդ հնարավորությունը չտվեց, քանզի վերջինս դեռևս գործի վարույթին ներգրավված չէր: Փաստաբան Նինա Կարապետյանցը հեռացավ դատական նիստերի դահլիճից:

Դատավորը կարգադրեց ուղեկցող գումարտակի աշխատակիցներին դատական նիստերի դահլիճ բերել Գալուստ Գրիգորյանին և նրան ներկայացրեց հանրային պաշտպան Արկադի Գևորգյանին: Դատավորը նշեց, որի նախորդ պաշտպանը գտնվում է ամենամյա արձակուրդում և Արկադիա Գևորգյանը ներկայացել է որպես վերջինիս փոխարինող: Ամբաստանյալը նշեց, որ որևէ ցանկություն չունի նոր պաշտպանի ներգրավման, իսկ մեղադրող և պաշտպանական կողմը առարկություն չհայտնեց: Դատարանը որոշում կայացրեց ներգրավվել հանրային պաշտպանին դատական գործի վարույթին:

Դատարանը արձանագրեց, որ դատական նիստին ներկա չեն պաշտպաններ Տիգրան Եգորյանը և Տիգրան Հայրապետյանը: Տիգրան Եգորյանը գրություն է ուղարկել դատարանին  այն մասին, որ ինքնազգացողությունը վատ է և խնդրել է դատարանին իր բացակայությունը համարել հարգելի: Իսկ Տիգրան Հայրապետյանի վերաբերյալ դատարանը որևէ տեղեկություն չուներ: Նրա վարքագծի վերաբերյալ որոշում կայացնելու համար դատավորը հեռացավ խորհրդակցական սենյակ:

 Դատավոր Տաթևիկ Գրիգորյանը կարգադրեց դահլիճ բերել ամբաստանյալներ Ժիրայր Սեֆիլյանին,  Գևորգ Սաֆարյանին, նրանց հայտնեց, որ իրենց պաշտպանները երրորդ անընդմեջ անգամ ներկա չեն գտնվել դատական նիստերի դահլիճում և առաջարկեց նոր պաշտպաններ ներգրավել գործին: Ամբաստանյալները հրաժարվեցին նոր պաշտպան ներգրավել գործին: 
Դատավորը պարզաբանեց, որ ամբաստանյալների հրաժարվելու դեպքում դատարանը կարող է հանրային պաշտպանի ներգրավել գործի վարույթին:
