ՊՊԾ գնդի գործով 15  ամբաստանյալներ հեռացվեցին նիստերի դահլիճիցԵՐԵՎԱՆ, 3 ՀՈՒԼԻՍԻ,ԱՐՄԵՆՊՐԵՍ: Երեւանի Ավան եւ Նոր Նորք վարչական շրջանների ընդհանուր իրավասության դատարանում դատավորԱրտյուշ Գաբրիելյանի նախագահությամբ հուլիսի 3-ին շարունակվում է Պարեկապահակային ծառայության գնդի գրավման անջատված գործով 18 մեղադրյալների առաջին դատական նիստը: Դատավոր Արտյուշ Գաբրիելյանըպարզաբանեց,թե ինչու է սույն գործը առանձին վարույթով իրականացվում. «Այս երկու գործերը ծավալով մեծ են, և դատարանը նպատակահարմար չի գտել 32 ամբաստանյալներով  քրեական գործ լսելը, քանզի դա  ֆիզիկապես հնարավոր չէ: Այդ է պատճառը, որ դատարանը գործերը չի միացրել մեկ վարույթով»:

Արտյուշ Գաբրիելյանն ընթերցեց ամբաստանյալների իրավունքները և պարտականությունները, ինչից հետո պաշտպաններին դատավորի ինքնաբացարկի միջնորդություն  վերաբերյալ հարց ուղղեց:

Ներկա գտնվող պաշտպաններից որևէ մեկը միջնորդություն չներկայացրեց:

 Պաշտպան Դավիթ Գյուրջյանը նկատեց, որ ոչ բոլոր պաշտպաններն են գտնվում դատական նիստերի դահլիճում և նրանց նույնպես պետք է դատավորի ինքնաբացարկի միջնորդություն ներկայացնելու վերաբերյալ հարցեր ուղղվեն: Դատավոր Արտյուշ Գաբրիելյանը նշեց, որ դատավորի ինքնաբացարկի միջնորդություն ներկայացնելու վերաբերյալ հարցերը իրենց նույնպես կուղղվեն, և նրանք չեն զրկվի այդ իրավունքից:

Դատավորը տեղեկացրեց, որ սույն գործով դատական նիստերը նշանակվելու են ամեն հինգշաբթի և պաշտպաններին հորդորեց իրենց աշխատանքը հարմարեցնել տվյալ գրաֆիկին: Նա հայտնեց, որ հաջորդ դատական նիստը տեղի է ունենալու հուլիսի 6-ին:

Պաշտպան Արայիկ Պապիկյանն ասաց, որ պաշտպանների մի մասը հնարավորություն չի ունեցել մտնելու դատարանի շենք և գտնվում է դատարանի շենքի մոտ: Այդ պաշտպանները հրաժարվել են կարգադրիչների կողմից զննության ենթարկվել՝ որակելով այն որպես խուզարկություն: Դատավոր Գաբրիելյանը 30 րոպե ընդմիջում հայտարարեց, որպեսզի մյուս պաշտպանները նույնպես մտնեն դատական նիստերի դահլիճ:

Ընդմիջումից հետո նախագահող դատավորի նիստերի դահլիճ մտնելու  ընթացքում ամբաստանյալները ոտքի չկանգնեցին, ուստի դատավորը, բացի ամբաստանյալ Արամ Մանուկյանից, քանի  որ վերջինս վատառողջ էր, սանկցիա կիրառեց նրանց նկատմամբ՝ նախազգուշացնելով, որ կրկնվելու դեպքում կարող է հեռացնել դատարանից:

Ամբաստանյալ Սերգեյ Կյուրեղյանը տեղից շարունակաբար խոսելու համար հեռացվեց դատական նիստերի դահլիճից: Դատավորը 30 րոպե ընդմիջում հայտարարեց:

Ընդմիջումից հետո նախագահող դատավորի նիստերի դահլիճ մտնելու  ընթացքում ամբաստանյալները նորից ոտքի չկանգնեցին, ուստի Արտյուշ Գաբրիելյանը նրանց նկատմամբ կիրառեց սանկցիա` հեռացնելով դատական նիստերի դահլիճից: Սանկցիան չկիրառվեց միայն Թաթուլ Թամրազյանի, Հովհաննես Հարությունյանի և Արամ Մանուկյանի նկատմամբ, քանզի վերջիններս վատառողջ էին:

Դատավորը ընթերցեց նաև դատական կարգադրիչների կողմից ուղարկված արձանագրությունը, որում նշված է, որ պաշտպան Մոնիկա Մարգարյանը հրաժարվել է դատական կարգադրիչների կողմից զննության ենթարկվել: Դատարանը հեռացավ խորհրդակցական սենյակ՝ պարզելու Մոնիկա Մարգարյանի բացակայության վերաբերյալ որոշում կայացնելու հանգամանքը:
