Պետք է դատավորների պատասխանատվությունը լինի, ոչ թե դատախազների կամ քննիչների. իրավապաշտպանը՝ գլխավոր դատախազի հայտարարության մասին

Առաջին հերթին պետք է դատավորների պատասխանատվությունը լինի, դատախազներին և քննիչներին պատասխանատվության ենթարկելը ոչինչ չի փոխի համակարգում: Այս մասին այսօր Tert.am-ի հետ զրույցում ասաց իրավապաշտպան Վարդան Հարությունյանը՝ անդրադառնալով գլխավոր դատախազ Արթուր Դավթյանի հայտարարությանը:

«Վճիռը կայացնում է դատավորը, դատախազը և քննիչը ընդամենը մեղադրանք ենք պաշտպանում: Մեկը կազմում է, մյուսը պաշտպանում է այդ մեղադրանքը: Առաջին հերթին պատասխանատուն պետք է լինի դատավորը, հետո նոր մնացածները: Դատավորը ինչպես շարունակում էր վճիռներ կայացնել, այնպես էլ կկայացնի, արդյունքում թող դատախազը կամ քննիչը պատժվի, իրեն ինչ»,- ընդգծեց Հարությունյանը:

Հիշեցնենք, որ «Ազատության» հետ զրույցում գլխավոր դատախազ Արթուր Դավթյանը նշել է, որ դատախազներն ու քննիչներն այսուհետև պատասխանատվության կենթարկվեն, եթե պարզվի, որ Հայաստանի դեմ Մարդու իրավունքների եվրոպական դատարանի (ՄԻԵԴ) կայացրած որոշումների համար մեղավոր են նաև նրանք։

Ըստ Վարդան Հարությունյանի` կարևոր է այն, թե ինչ կարգի պատասխանատվություն է նախատեսվում դատական և իրավապահ համակարգի աշխատողները համար: Նրա համոզմամբ՝ մեր ավելի լավ և ավելի ճիշտ կհասկացվի, եթե նրանց գրպանին կպնեն:

«Եթե դատավորը իմանա, որ պետք է իրենից գումար գանձվի, ապա նա երկար կմտածի՝ կատարել դատախազի պահանջը կամ խնդրանքը, թե ոչ: Կատարի՞ իշխանության հանձնարարությունը, կամ կատարելուց ինչպե՞ս կատարի: Իսկ ընդհանրապես, ճիշտ ձևը պետք է լինի դատավորի անկախությունը: Լուծումը՝ դատավորի բացարձակ անկախությունն է»,- ընդգծեց նա:

Ինչ վերաբերում է ՄԻԵԴ-ի կողմից Հայաստանի դեմ կայացվող որոշումներին, Հարությունը նշեց, որ դրանց պատճառը ՀՀ-ում դատարանների ոչ անկախ լինելն է: Ըստ նրա՝ ՄԻԵԴ-ի վճիռները հետագայում ավելի են շատանալու:

«ՀՀ-ում դատարանը, չլինելով անկախ, կատարում է քննչական մարմինների, դատախազության կամ քաղաքական գործերի դեպքում՝ իշխանությունների պատվերները:  Դատավորը, անկախ չլինելով, կայացնում է անարդար վճիռներ և վերջում դրանք ինչ-որ ձևով անդրադառնում է Հայաստանի բյուջեի վրա»,- ասաց իրավապաշտպանը:

Նա համամիտ չէ այն կարծիք հետ, որ Հայաստանի դեմ ՄԻԵԴ-ի վճիռները դատական համակարգը բարելավելու համար են: Ըստ նրա՝ բարելավելու համար պետք է ոչ թե դատարանների վճիռները համարել սխալ կամ օրենքին չհամապատասխանող, այլև դատավորները մասնագիտական որակները բարձրացնել:

«Եթե ցանկանում են աջակցել և օգնել, ապա մեր դատավորները, ենթադրենք, եվրոպական երկրներում փորձաշրջան անցնեն: Աջակցության բազմաթիվ լավ ընկալվող և հայտնի ձևեր կան: Եվրադատարանի վճիռները չեն կարող մեր դատավորներին օգնող հանգամանք լինել»,- նշեց Հարությանը:

Նրա կարծիքով՝ եթե Հայաստանում դատական համակարգը անկախ լինի, դատավորների գրագիտությունը ներում կայացնել այնպիսի վճիռներ, որոնք ՄԻԵԴ-ում չեն բեկանվի:
