«Սասնա ծռերից» Արայիկ Խանդոյանի և Արեգ Կյուրեղյանի պաշտպան Արա Ղարագյոզյանը հայտարարություն է տարածել իր նկատմամբ կարգապահական վարույթի վերաբերյալ։

Նշենք,որ «Սասնա ծռեր»-ի գործով հունիսի 28-ին ՀՀ Երևան քաղաքի Ավան և Նոր- Նորք վարչական շրջանների ընդհանուր իրավասության դատարանում տեղի ունեցածից հետո փաստաբան Արա Ղարագյոզյանի կողմից արված հայտարարությունների առնչությամբ գործով նախագահող դատավոր Արտուշ Գաբրիելյանը դիմել է ՀՀ փաստաբանների պալատ՝ նրա նկատմամբ կարգապահական վարույթ հարուցելու հարցով:

Արա Ղարագյոզյանի հայտարարությունը ներկայացնում ենք ստորև.

«Ինչպես հայտնի է, ՀՀ Երևան քաղաքի Էրեբունի և Նուբարաշեն վարչական շրջանների ընդհանուր իրավասության դատարանի դատավոր Ա.Գաբրիելյանը հունիսի 29-ի գրությունով դիմել է ՀՀ փաստաբանների պալատ՝ ինձ կարգապահական պատասխանատվության ենթարկելու պահանջով: ՀՀ քրեական դատավարության օրենսգրքի 314.1 հոդվածի համաձայն՝ գործի քննությանը որպես կողմի ներկայացուցիչ կամ պաշտպան մասնակցող փաստաբանի նկատմամբ կարող են կիրառվել նախազգուշացման կամ պատասխանատվության ենթարկելու վերաբերյալ դիմումով Փաստաբանական պալատ դիմելու ձևով սանկցիաները: Ընդ որում, Փաստաբանական պալատ դիմելն իրականացվում է նույն դատական նիստում կայացվող դատարանի առանձին որոշմամբ: Դատավորի՝ ՀՀ քրեական դատավարությանն անփույթ տիրապետելու փաստը հավաստվում է վերջինիս կողմից թույլ տրված հետևյալ կոպիտ խախտումներով: Նախ, Դատավորն ինձ պատասխանատվության ենթարկելու պահանջով Փաստաբանների պալատ դիմելու վերաբերյալ պետք է որոշում կայացներ հենց դատական նիստի ընթացքում, բայց նա ընդհանրապես այդ հարցին չի անդրադարձել ոչ դատական նիստի ընթացքում և ոչ էլ նիստից հետո, ինչի վկայությունն է նաև Դատավորի գրությունը: Բացի այդ, Դատավորը ՀՀ փաստաբանների պալատ պետք է ուղարկեր ոչ թե գրություն (որի բովանդակությանն արդեն բոլորս ծանոթացել ենք), այլ առաջնահերթ պատասխանատվության ենթարկելու վերաբերյալ որոշում: Այսպիսով, ՀՀ Երևան քաղաքի Էրեբունի և Նուբարաշեն վարչական շրջանների ընդհանուր իրավասության դատարանի դատավոր Ա.Գաբրիելյան, հրապարակավ ինձ իրավունք եմ վերապահում Ձեր վերաբերյալ հայտնել հետևյալ հիմնավոր գնահատականը.
