Հողային օրենսգրքում արված օրենքի փոփոխությունների գաղափարը լավն է, մեխանիզմները՝ոչ. Tert.am-ի հետ զրույցում նման կարծիք հայտնեց փաստաբան Տիգրան Աթանեսյանը, մասնավորապես, ի պատասխան հարցի, թե որքանով է արտագաղթած նախկին ՀՀ քաղաքացիները հողն աճուրդով վաճառելու կառավարության որոշումը տեղավորվում Սահմանադրությամբ ամրագրված՝ մարդու սեփականության իրավունքի հետ:

«Ոչ մի իրավունք, որտեղ էլ այն ամրագրված լինի բացարձակ չի և պետք է համահունչ լինի այլ շահերի հետ: Օրինակ՝ Դուք ունեք բնակարան և Դուք չեք կարող Ձեր 6-րդ հարկում գտնվող բնակարանում ջրային ակումբ կառուցել: Եվ տվյալ դեպքում, եթե այս հողերն անմշակ են, արդյունավետություն չունեն,  հողը լքված է, անտեր, պետության իրավունքն է՝ կարգավորել այդ հարաբերությունները: Եվ գաղափարը, կարծում եմ, նորմալ է: Այլ հարց է, որ մեխանիզմները լավը չեն»,-ասաց Տիգրան Աթանեսյանը, ով որպես փաստաբան առնչվում է քաղաքացիների սեփականության իրավունքին վերաբերող հարցերին:

Հիշեցնենք, որ Կառավարության կողմից ԱԺ քննարկման է ուղարկվել «Հողային օրենսգրքում» և կից օրենսդրական փաթեթում արված օրենսդրական փոփոխությունների նախագիծ, որով նախատեսվում է, որ ՀՀ քաղաքացիությունը կորցրած անձը զրկվում է գյուղատնտեսական նշանակության ունեցող իր հողամասի նկատմամբ սեփականության իրավունքից:

Եվ ըստ նոր պահանջների՝ սեփականատերը պետք է մեկ տարվա ընթացքում օտարի այն, կամ տեղական ինքնակառավարման մարմնի դիմումի հիման վրա՝ դատարանի վճռով, հողակտորը վաճառվում է հարկադիր կարգով, իսկ գումարը փոխանցվում է նախկին սեփականատիրոջը:

Անդրադառնալով կոնկրետ մեխանիզմներին, որոնք իրեն դուր չեն գալիս, Տիգրան Աթանեսյանն ասաց, որ, նախ, 1 տարի ժամկետը շատ փոքր ժամկետ է:

«Այսօրվա տնտեսական վիճակում գտնվող Հայաստանում մարդուն նման վիճակի մեջ դնելը ճիշտ չէ, և մյուս կողմից, որ դրանով զբաղվելու են գյուղապետարանները, համայնքապետարանները, այո, ես էլ չեմ բացառում, որ «հողահավաք» լինի ( երբ հողերը հայտնվեն մեկ-երկու տեղական հողային ֆեոդալների ձեռքում՝ մեկ մարդու կողմից ուղղորդված գնումների դեպքում) և մյուս կողմից՝ հասկանալի չէ, թե որպեսզի հողին շուկան կայանա, ինչ որոշակի գներ են լինելու: Քանի որ չեմ բացառում, որ այդ հողերը՝ կադաստրային արժեքով, կոպեկներով վաճառվեն և հայտնվեն ինչ-որ մեկի ձեռքում»,-ասաց Տիգրան Աթանեսյանը:

Նրա ամփոփմամբ՝ առաջանալիք տարբեր վտանգների առկայության դեպքում գլխավոր խնդիրը, որը դրված է նախագծի հիմքում, այն է, որ այդ հողերը պետք է մշակվեն, չի լուծվում:

Ըստ փաստաբանի՝ սրա համար պետք են ինչ-ինչ պետական երաշխիքներ և օպտիմալ գին, որը ամեն տարի պետք է որոշվի Կառավարության կողմից:

Նշենք, որ  այս օրենսդրական նախաձեռնությունը արված է  արդեն տարիներ շարունակ Վրաստանում գործող  վրացական մոդելով: Նշենք, որ Վրաստանում երկրի քաղաքացիություն չունեցող անձը չի կարող որպես սեփականություն ունենալ հող:
