«Սասնա ծռերի» գործով դատարանում տեղի ունեցած միջադեպերով իրականացվում է քննություն

Երեւանի Ավան եւ Նոր Նորք վարչական շրջանների ընդհանուր իրավասության դատարանում հունիսի 28-ին տեղի ունեցած դեպքերի կապակցությամբ իրականացվում է քննություն: Այս մասին NEWS.am-ին հայտնեցին գլխավոր դատախազության հանրային կապերի բաժնից:

«ՀՀ ոստիկանության Երևան քաղաքի վարչության ուղեկցող գումարտակի հրամանատարի կողմից զեկուցագիր է ներկայացվել այն մասին, որ դատական նիստերի դահլիճում ոստիկանները կանխել են ամբաստանյալ Արեգ Կյուրեղյանի կողմից Սմբատ Բարսեղյանին արգելված առարկա փոխանցելու փորձը, որից հետո Արեգ Կյուրեղյանը դրսևորել է ագրեսիվ վարքագիծ, չի ենթարկվել ոստիկանների օրինական պահանջներին, ոտքի է կանգնել, փորձել է տեղից դուրս գալ, ինչին հաջորդել է Սմբատ Բարսեղյանի և Մխիթար Ավետիսյանի հակաիրավական վարքագիծը: Նշված անձանց ապօրինի գործողությունները  խափանելու, անվտանգությունն ապահովելու նպատակով, վերջիններս դուրս են բերվել դատական նիստերի դահլիճից և տեղավորվել հատկացված խցերում, որի ընթացքում նրանց կողմից ցույց տրված դիմադրությամբ պայմանավորված՝ կիրառվել են հարկադրանքի միջոցներ:

Համաձայն նշված զեկուցագրի՝ դատարանի կողմից դատական նիստերի դահլիճից հեռացված և իրենց հատկացված խցերում գտնվող ամբաստանյալներ Արայիկ Խանդոյանը և Գագիկ Եղիազարյանը, արձագանքելով ոստիկանների նշված իրավաչափ գործողություններին, սկսել են ոտքերով և ձեռքերով հարվածել խցերի դռներին:

Նույն օրը ՀՀ արդարադատության նախարարության «Երևան-Կենտրոն», «Նուբարաշեն», «Վարդաշեն» քրեակատարողական հիմնարկներում ամբաստանյալներ Արայիկ Խանդոյանի, Մխիթար Ավետիսյանի, Գագիկ Եղիազարյանի, Սմբատ Բարսեղյանի և Արեգ Կյուրեղյանի բժշկական զննությամբ հայտնաբերվել են մարմնական վնասվածքներ: Արայիկ Խանդոյանը, Գագիկ Եղիազարյանը և Մխիթար Ավետիսյանը հայտարարել են, որ վնասվածքները ստացել են Երևան քաղաքի Ավան և Նոր-Նորք վարչական շրջանների ընդհանուր իրավասության առաջին ատյանի դատարանի վարչական շենքում: Սմբատ Բարսեղյանը և Արեգ Կյուրեղյանը հրաժարվել են տեղեկություններ հայտնել վնասվածքները ստանալու հանգամանքների վերաբերյալ:

Նկարագրված դեպքին առնչվող նյութերը ՀՀ գլխավոր դատախազության կողմից ուղարկվել են ՀՀ հատուկ քննչական ծառայություն՝ պատշաճ քննությամբ նշված հանգամանքներն ստուգելու և իրավական գնահատականի արժանացնելու հանձնարարությամբ»,- հաղորդում են դատախազությունից:
